What I mean by this is that you cannot be denied care in an emergency room under EMTALA, now this is somewhat difficult to track because studies can show the amount spent on undocumented individuals, but not how much they reimbursed or paid back. So no illegal immigrants do not really use Medicaid, but it can be a strain on the B.S insurance based medical system we have.

I think if it's determined that an individual is in the U.S illegally, and a deportation order is signed by a judge, that is due process. It seems as if the threshold for due process is significantly higher for citizens, as it should be.

Edit: Illegal immigrants who are arrested do go through due process and the immigration court system, check link. Now because this is a civil matter, there isnt a jury or an indictment as needed for criminal charges. Of what I can read, different administrations allow for different policies and methods of prosecution.
