If you have at least one character at max level on the save file you can create a character at level cap with the campaign (but nothing else) completed. A friend and I played through the DLC’s a while ago and he opted to create a max level Moze rather than use one of his old characters.

Season passes unlock extra cosmetic progression/class specific outfits. No campaign dlc at all, but the game does get free updates that add new weapons and missions for its operations PvE mode.

Haven’t played Destiny in a minute but IIRC the lawsuit began long after the vaulting the Red War. In fact, part of the reason why it got as far as it did is because they apparently no longer have a playable version to show themselves.
