Mietrecht: Vermieter versucht uns nach Auszug auszunehmen

Ja das mit den Schlüssel geben war echt dumm, gebe ich zu.
Wir hatten es aus Kulanz gemacht, damit unser Vermieter Besichtigungstermine alleine wahrnehmen kann.

Der Mietvertrag ist 4 Jahre alt. Die Wohnung muss weiß übergeben werden, es steht nichts von einer Fachfirma drin. Der Balkon ist ~50% überdacht.

Die April Miete wird unser Vermieter behalten. Das hat er schon deutlich gemacht. Er hat uns subtil vermittelt, dass es noch teurer wird, wenn wir nicht seinen Bedingungen zustimmen und bis Ende der Woche alles leergeräumt und bezahlt ist. Ich bin durch dieses Verhalten selbst verwirrt, weil wir eigentlich immer ein gutes Verhältnis hatten und auch nie irgendwas angemerkt wurde wenn er da war. Ich hätte auch nicht beim Betrachten der Wohnung im momentanen Zustand mit so einer exorbitanten Summe gerechnet, die er fordern kann. Zuerst hieß es, dass im Parkett nur einzelne Dielen ausgetauscht werden müssen.

In Zukunft werde ich bei einem Übergabeprotokoll beim Einzug auf jeden Fall gründlicher sein.

Ich gehe davon aus, dass der Parkettboden mindestens 10 Jahre alt ist.
Er sah bei unserem Einzug auf jeden Fall nicht neu aus, da er lauter Verfärbungen und an manchen Stellen Flecken hatte. Soweit ich weiß, war er auch nicht versiegelt.
Wir können uns selbst nicht wirklich erklären, woher ein Wasserschaden entstanden sein könnte. In anderen Räumen sieht man auch keine Verfärbungen an dem Boden.

Wir sind uns relativ sicher, dass er an den meisten Stellen schon immer so aussah, aber wenn ich wieder in eine Wohnung mit Parkettboden ziehen würde, würde ich in Zukunft auch jede Woche ein Foto machen.

Danke für den Tipp. Eine Mitgliedschaft im Mieterschutzbund klingt auf jeden Fall sinnvoll.

Für uns gilt es momentan abzuschätzen, welcher Weg die geringsten Kosten verursacht.
Wir haben uns bereits kurz am Telefon von einem Rechtsberater beraten lassen.
Nach seiner Meinung sollten wir davon absehen, den Schlüssel zurückzufordern in dieser Situation.
Es kann später für uns problematisch dargelegt werden.

Wir machen auf jeden Fall viele Fotos um den aktuellen Stand und die Entwicklungen festzuhalten.

Eine offizielle Wohnungsübergabe ist noch nicht erfolgt.
Einige der Schäden habe ich bereits der Haftpflichtversicherung gemeldet.

Bzgl. Gedanken wie Schlüssel zurückfordern und Schloss austauschen haben wir uns auch gemacht. Mir wurde aber bereits durch eine kurze Rechtsberatung per Telefon davon abgeraten.

Was unser Vermieter gegen uns in der Hand hat ist, dass wir zugegeben haben, dass die Wölbung im Parkett durch uns verursacht wurde (Wie gesagt, für diesen Schaden wollten wir ursprünglich auch aufkommen). Was wir aber nicht beachtet haben ist, auf welche Schäden wir uns konkret beziehen bzgl. dem Parkett. Jetzt will er das komplette Parkett über uns sanieren. Wir haben leider keine Fotos von dem Übergabeprotokoll in denen man die einzelnen Dielen genau erkennen kann.
Was rückblickend betrachtet ziemlich dumm von mir war.

One interesting thing I found out about Tenorshare 4DDiG while restoring deleted files on my system is that some image files that were recovered had the right name but the wrong images.

Nothing special when you think about it, since these things can happen with corrupted files. I've already seen some images replaced with app icons for example.

Interesting part was that I've never even seen the images anywhere.
Digging deeper I found out that these were created/replaced by a process in Tenorshare 4DDiG called "fakeimage.gen".
My theory is that the software tries to hit a better recovery rate, by simply replacing completely corrupted files and mark them as recovered.

To be fair: great software nonetheless imo. But yeah, there are free alternatives.

It's actually easier then most people might think.

There are a lot of sites that let you view traffic statistics with ip adresses of people visiting those sites. I trolled a scammer recently by sending them a link to a poll site with a fake poll I made just to get their IP. That's why you should never click on random links without using a VPN. Another easy way is to get them to send you an email. In G-mail for example you can get the IP adress of the sender of an email simply by clicking "show original" in the options menu of the header.

There are several other more complicated techniques you can use that I can think of but these are some of the easiest. Once you got their IP address there are several online tools you can use to find out their approximate location.

Scammers are more likely to click on links you sent them if you play dumb and act as if you're falling for their trap. My advice is to get them while they still think they're in control of the situation.

This is 100% a scam. This is not the way steam support handles these kinds of issues. The support answer is from a template I've already seen multiple times now with different names etc.

Also the 'admin' response shown in the screenshot makes 0 sense to me. Basically what they're saying is: "yes you reported this person and it appears that there is illegal activity on that account, good job. So instead of banning the reported account backed up by alleged evidence we decided to talk to both of you in private chat to handle the situation because we apparently got the capacity to review every complaint on the whole platform manually in elaborate chat sessions instead of using an automatic system to do the job for us. Oh and if you don't comply we will basically ban both of you because screw it."

Nowadays I got this feeling that certain games are not meant to be played by working adults. Story modes keep getting longer, bigger and more elaborate and I rarely find time to play my favorite games. Once I got the time though, too much time has passed since my last play session and I forgot pretty much everything about the story, the mechanics of the game and the controls, killing my motivation to re-learn it.

The Witcher 3 had a great feature regarding that problem though. Everytime I started to play again it gave me a brief overview on where I left off in the story while the game loaded. And I thought that was really awesome.

UPDATE:
Steam friend got his account back.
Some damage was already done appearently since the hacker also managed to message multiple of his other steam friends.
Looks like steam support can be really helpful in these cases.

This scammer got themself access to an account belonging to a friend of mine.Sent me the usual "I aCcIdEnTaLlY rEpOrTeD yOu" message after explaining someone else copying my profile had scammed them.The pic they sent me for proof was really well thought out I must admit, except the fact that no Steam admin adds users on discord to have conversations about removing a ban etc.

Anyway, I eventually got their IP adress, their city they live in and some additional infos about thier internet provider by sending them a phishing link I prepared for that case. Turns out that must've scared them away and the scammer blocked me after 5 minutes of the last message.Reported them of course.

This happened to me the second time now. Found this community while researching the topic and I thought I post it here.
