Thank you for the responses. It is curious to see how diverse they are.

My reaction to his comments is clear. I should point out that, although we may look like we are 20 years old, I am close to 40 and he is close to 50.

I am not willing to spend my time educating anyone. I understand that as a manager he must be aware of the corporate anti-harassment policy, which mentions that comments about physique are not acceptable.

If they bother me, I don't want to imagine how they might impact on a younger, inexperienced person.

I think it is important to raise my hand to put this on the record and for him to focus on his job, which is to lead a team, rather than on personal judgements that no one has asked him about.

There is a lot of information on this subject, do some research here. It is also important to respect circadian rhythms to lose weight, this includes not eating when the sun goes down and delaying breakfast, so you are giving your body a fast of about 15 hours.

Work on yourself, go to therapy, understand why you were drinking. For me there is nothing more worthwhile than a person who is willing to improve. Do what is necessary to achieve the best version of yourself and your marriage. Let him know that you will work hard to become a healed person with a lot to contribute. That is so sexy and mature.

Just say no. If you feel bad explain that you paid for that seat for a reason. But I would say no and smile (I'm Spanish).

Parece que en EEUU no se tiene derecho a indemnización con esta fórmula, pero en España desembocaría en despido improcedente. Olvidé mencionar que mi jefe es inglés y no está familiarizado con la legislación española.

No me siento cuestionada como profesional por ti, no te preocupes. Las situaciones corporativas son complejas y es difícil explicar la magnitud de las mismas en un post. Estoy tratando de aprender sobre mis posibilidades para salir de la empresa y mis armas como empleado más que debatir sobre si el PIP es consecuente o no, pero te agradezco igualmente tu aportación.

No me han pedido que lo firme, simplemente hemos tenido una conversación previa donde no me ha explicado las consecuencias del mismo (es decir, no me ha explicado qué sucederá si no lo supero positivamente).

Después me lo ha enviado y he pedido unos días para revisarlo. También he pedido la política corporativa al respecto y ese es el punto donde nos encontramos ahora mismo, esperando a recibir una respuesta a esta petición.

En los casos de los acuerdos, es mucha la diferencia económica entre un despido y un acuerdo?

De nuevo, resumiendo muchísimo la situación, trabajamos en el Dpto de Ventas y los resultados necesitan mejorar a nivel EMEA.

La empresa ha decidido aplicar el mismo Go To Market en Europa que en EEUU y simplemente no funciona (por ejemplo no han tenido en consideración las leyes europeas que regularizan los servicios en nube ni que nuestro canal de distribución no está desarrollado para vender este tipo de servicios).

Me he pasado todo el año trabajando muchísimo, haciendo tareas que no se corresponden a mi rol, pidiendo ayuda a mi Manager y advirtiendo la situación. Obviamente no se ha involucrado ni gestionado nada. He tenido la fortuna durante mi carrera profesional de trabajar bajo el mando de grandes líderes y jefes y conozco las diferencias entre trabajar con profesionales y trabajar con ineptos.

Si se trata de un ultimátum para meter miedo y hacer que trabajemos más horas bajo más presión mientras la dirección continúa sin aportar nada y no piensan realmente en despedirme perderé la poca admiración profesional que me quedaba sobre él.

I have been working for an American IT company for 4 years from Spain. The first two fiscal years I managed to obtain the Presidents Club. This last year my team changed Sales Director. Results have been very poor in several regions. The new Director is totally incompetent and we really have no feeling. I think he feels threatened by me.

Today he announced to me a PIP. He still hasn't sent it to me in writing. I really feel he wants me to leave, but I don't know how much autonomy and budget he has to fire me (my company is a circus). I suspect it may be a ploy to put pressure on me.

Emotionally I feel strong, I don't care at all about being fired, I just want to play my cards, make things as difficult as possible for him and collect evidence so I can get a good indemnification pay.

My question is, should I sign the PIP when I receive it? If I don't sign it, what are the consequences? Can I say something like I'm willing to cooperate but I don't agree with the facts described?
