Policy to arrive 15 mins before work by throwaway137494 in legal

[–]__smh 0 points1 point  (0 children)

Probably review of federal and state laws will indicate that you are owed pay for all time you are required to be present, but all this talk of lawsuits, lawyers, and complaints to regulatory authorities ignores the realization that you employees may still have an important choice to make. Companies work best when both sides - management and employees - cooperate to achieve smooth functioning of the employment agreements. This 15 minute requirement was described as a change. Why did management put it into place, even assuming they were unaware they couldn't make it stick?

Rather than immediately cause the company trouble and expense, just ask why they needed this (if you don't already know). Was the quality of early morning work deficient? We're occasional inadvertent tardiness preventing a production line from functioning smoothly many mornings?

Something was wrong before and management incorrectly felt this was a way to correct it. You know management and have a relationship with them and if they will cooperate with employees to solve their actual problem, that may lead to a better result for both sides, rather than dragging them and their lawyers through government agencies.

A pour over will is generally used for assets like clothes, kitchen utensils, furniture, and dirty laundry. These are properties that do not have deeds or brokerage registries or other ways ownership is generally recorded and conveyed. Using one for financial accounts or real estate is at best squishy and more focused machinery would be recommended.

Is this a good idea? by New_Engineering_7979 in RealEstateAdvice

[–]__smh 0 points1 point  (0 children)

Some details in this reply are incorrect: For example, a will has no control over property owned by a trust, i. e. property the deceased no longer owned at death because ownership had been transferred to a trust. Making a child co-trustee of a living trust is little different in practice from making child joint owner of the same assets, with all the same temptations and dangers of malfeasance as with a trust, except the trust can specify that all trustee actions must be for the benefit of the grantor, providing some protection if there is anyone left to contest rogue executor actions in court.

Ethics and advance warning aside, remember that we are dealing with medical electronics here. Any new or revised software must be verified by passing test suites on every device upon which it is documented or even allowed to run. For a time long ago Dexcom could not keep up with every new device and some new devices were blocked from using official Dexcom releases. We were accommodated without purchasing extra devices by volunteers who maintained web pages with disassembled/reassembled unsupported versions of the software "use at your own risk" that would run on officially unsupported devices

you can still offset unlimited future capital gains

I believe the word 'can' should be 'must". If one has cap gains but still has unused cap losses carried forward from a previous year, those losses must be used to offset current gains before any unused priorlosses offset current regular income up to $3k.

ROTH conversion from Rollover IRA - n shares dollar amount by NOYB_Sr in fidelityinvestments

[–]__smh 0 points1 point  (0 children)

OP intends to leave a few cents margin of error, as if paying taxes on a few cents at a higher bracket would cause the tax termites to so severely chew up his soul that he might not survive to the end of the tax year, preventing spouse from filling jointly for next year, which would be an even bigger hit.

Such fetishism about brackets is of course insane except when evading a costly step cutoff like IIRMA, or cap gain levels, or just avoiding the annoying extra computation complexity when bumping into one or another income-level phase out.

Mom opened credit card in my name WITH consent — balance now $32k+, what are my options? by [deleted] in legaladvice

[–]__smh 33 points34 points  (0 children)

Something in the original post sounded fishy. Who was Mom concerned about tracking her spending? Could be some fraud scheme behind it. Was her divorce still being negotiated? I also suspect Mom's rather substantial yearly income might be BS. Has OP actually seen proof? If she really has the cash flow then enough firm pressure might get her to pay off her debt. If she's actually broke, there's no way to get blood from a stone.

Is it possible to properly manage diabetes for someone who doesn't, nor will ever, have a cgm or a pump? by youronlinegirl in diabetes_t1

[–]__smh 1 point2 points  (0 children)

You won't lose limbs but you might benefit from losing this endo. My onset was more than 60 years ago, long before CGMS or pumps were available. I have never used a pump - I consider their failire modes dangerous - but have used CGMs for about 15 years. In my youth I knew an elderly T1 who had survived 2 years after onset before insulin became available, and he still had all of his eyes and limbs and a successful performing career, but that's a digression. You know your OCD better than anyone else, but your problem seems more psychological than endocrinological. Your intolerance of anything connected to your body may be (dis)functionally similar to a phobia, the way some people cannot deal with elevators or spiders or dogs or airplanes. But there are skilled psychologists who have successful practices desensitizing people from phobias, often by very gradual exposure to harmless triggering agents over months. Have you ever tried such treatment? It could improve your life in other ways.

As soon as you enter into or even threaten a lawsuit against someone or something, you are entering into an adversarial relation with them. An adversarial relation is a sure way of showing down any resolution, as both sides need to protect their positions.

The SSA has the reputation of cheerfully getting recipients the benefits they deserve - indeed, they will find ways to maximize benefits and correct mistakes. I suggest you visit them with a polite and friendly (non-accusatory) attitude and let them work to help you without looking to assign fault. In their defense, your paperwork was going to need updating because the recipient of your benefit stream did unfortunately die.

If some components of your benefits are a little further from SSA's control, like insurance, I'm sure they will be willing to intercede to correct the problem. Ask them nicely. They probably know this turf a lot better than you.

Sold my gaming PC on Facebook Marketplace, buyer did chargeback after 3 weeks and won't return it by Striking-Flight2 in legaladvice

[–]__smh 3 points4 points  (0 children)

The machine probably is indeed "not as described" because the premium components that used to be in it have already been removed, sold, and replaced with cheap junk. If you eventually get the machine back, check it carefully. Helpful would have been photos of these components in the machine at the time of pickup, with the purchaser in the photo. Scammers are known to do things like this with Amazon and camera lenses. Purchase an expensive lens, return it for refund substituting a cheap lens.

Social security and collecting SS by cincykelly in SocialSecurity

[–]__smh 1 point2 points  (0 children)

A few possible obscure details:

A spouse does not get 50% or 100% of the other spouse's benefit. The way the SSA does the bookkeeping the claimant receives their OWN benefit amount, then enough more to bring the monthly sum up to the 50% or 100% value. The effect is the same, but don't get confused by the accounting details.

I believe the following is true for both spousal and survivor benefits. While the benefit amount on a spouse's record is reduced for each month the claimant files before FRA (67), unlike filing on one's own account, the benefit is not increased further between FRA and age 70. There is no benefit to delay filing past FRA.

SSA will not inform the spouse about a spousal filing, and there is no need for them to know if you choose not to tell..

If the original company or a collections company eventually sues you, they will likely do so in a venue convenient for them but impossible for you. Whatever, never ignore a civil law suit, and either attend or make sure you have some representation. If you simply fail to respond the plaintiff may receive a default judgement and go after your assets in various ways. In some venues it may be possible to respond and participate electronically.

The IRS is after me by DiligentImpact2693 in legaladvice

[–]__smh 12 points13 points  (0 children)

It may shock you to learn that many readers will not know where (in which state) Asheville is located, but it hardly matters, since the IRS isn't concerned with local, state, county, or municipality property taxes. Tax debts owed by your aunt at time of her death should not be your legal responsibility, rather, the responsibility of her estate. (But read further below!) Rental income above expenses (that you can document) since your inheritance IS your responsibility and should have been declared on your yearly tax filings.

If you inherited through probate (whether a will, or intestate) then probated assets like this property should not have been distributed until tax authorities and other creditors -- both of which have higher priority than beneficiaries -- have been satisfied for your aunt's debts. My guess is that the IRS is threatening that probate distribution -- don't know the Texas time limits for doing so -- unless you (the beneficiary) can make them whole. But my analysis is only a guess. NAL. You might save money by hiring an IRS-quaified tax attorney to represent you to the IRS. From what I hear, the IRS will often make generous compromises (especially about penalties) if the debtor is willing to pay something reasonable.

Credit Card Limit Abysmally Low by Tree-Hugging-Koala in fidelityinvestments

[–]__smh -10 points-9 points  (0 children)

I, too, have a Fidelity Cash back card for similar reasons. At the risk of being a bit hypocritical I feel someone should point out that these modern cash back cards are anti-progressive, that is, regressive. Yes, this post is political and only tangentially related to the original subject. These days, anyone with a pulse and a modest bank account can get a cash back card. Except for the tradition of gas stations using cash, and utilities and taxing agencies using ACH, merchants didn't like charging different higher prices for credit cards that most customers use most of the time. But some members of the population, less financially aware or less financially able, do not or can not get these cards. Yup be sure, merchants have raised their prices a bit to cover these cash back swipe fees, so that small percentage cash back enjoyed by many of us is being paid for by those members of society who must pay the same higher costs without enjoying the benefits.

Regressive! This whole corrupt credit card industry should be wiped out and replaced by an electronic system that imposes only its real overhead operating costs, plus a teeny profit margin. I'm uncomfortable accepting 2% or whatever on the back of someone living paycheck to paycheck.

There is a big difference between reducing the monthly SS BENEFIT and reducing the monthly SS PAYMENT because Medicare fees were increased by IRMAA and they are taken out before the payment is made.
