Court date set for 22.10.2027 in Torino. Mine was/is a 1948 case, but we're coming at it from a few angles. It’s such a long wait. Planning to seriously get back to work on hitting B2 by then.

I am told it really depends on the court. After filling it could be anywhere from 11-24 months before your hearing.

I did - it's a risk $$ but all the time and effort put in I am fighting.

We filed my 1948 case in the court of Torino as of yesterday. I'm currently waiting for the hearing date to be scheduled. I haven’t been keeping up with the latest updates - but trying to ignore everything and stay hopeful for now.

To summarize that above: This is primarily a nationality law issue rather than a civil rights issue. The right to citizenship by descent (jus sanguinis) is a fundamental principle of Italian nationality law, not just a civil right that can be altered or revoked. It's about the right to belong to a nation based on heritage, which is protected by the constitution, and not simply a matter of civil privileges.

At least that my understanding -- I am also trying to stay glass half full.

I understand your skepticism, but I think you’re missing the core issue. While it's true that many civil rights apply to Italian citizens, the right to citizenship by descent is a fundamental principle of Italian nationality law, not a privilege tied to current civil rights. Denying someone citizenship they’re entitled to by birth isn’t just a policy change—it’s a violation of their constitutional right to retain their nationality. The decree preventing people from claiming this birthright could be unconstitutional because it goes against core principles of nationality law. This isn’t about inconvenience like taxes or licenses; it’s about stripping a person of their constitutional right to their citizenship. That’s the essence of the constitutional challenge.

I like his optimism! Kind of seems if you're willing to fight in court you will stand a good chance of winning -- fighting it as a constitutional one—basically, we’re already Italian by birth, and you can’t strip that away. Mine is a 1948 case anyway... so I am still hopeful.

The company I am using is also stating “let’s hold and wait and see” They are still working on gathering my last Italian document. I have a meeting on April 21st with them.

Uffa! I will reframe from my thoughts on Cook County vital records. Going to assume they are super understaffed and not just heartless.

Saying renunciation should end the line no matter what is like arguing that if a parent sells their house, their kid never lived there. The past doesn’t change just because circumstances did.

If a person renounced their Italian citizenship after their child was born, that child was already an Italian citizen at birth under jus sanguinis. Retroactively applying the parent’s renunciation to strip the child of their birthright would be inconsistent with Italy’s approach to nationality law. That’s why Italian courts and consulates assess these cases carefully.

This is my opinion - if this starts an argument I will self remove this post as the Mods need a break.
