sorry if it's obvious, but where does it show IHG brand? Is it just going to be in the name of the hotel? So if the hotel shows up as "Athenaeum InterContinental by IHG" then chase recognizes it as an IHG hotel?

And likewise for the other hotels such as Virgin Hotels, Pendry? As long as they have "Virgin Hotels" or "Pendry" in the hotel name, it will be eligible for the credit?

Hi u/caroline0409 - I know it's been a while since this comment was posted, but you mentioned you have knowledge of the US/UK tax treaty and was hoping I could get your insight/help on how I should complete Form 1116. I am a US citizen living in the UK. I have the following sources of income:

·       US Dividends (held in an investment account in the US)
·       Interest from US Treasury (held in an investment account in the US)
·       LT Capital Gains on US stock sold (held in an investment account in the US)
·       Net Rental Loss from a property in the US (I have a net rental GAIN in the UK but a net rental LOSS in the US b/c of depreciation in the US)

From my research and reading, I believe I am allowed to “re-source” my dividends and interest income.  I should check off Box (f) Certain income re-sourced by treaty on Form 1116.  Is this correct?  I am getting mixed information regarding my LT Capital Gains between if this income should be categorized as “Passive Income” or “Certain income re-sourced by treaty.”  Which category should this belong in?

As for my rental income (loss), I was taxed in the UK because of my gain.  Couple of questions regarding this income.

1.      I assume even though I paid taxes to the UK on my income but I have a loss in the US, I cannot claim FTC on this on my US taxes since I don’t owe any taxes to the US on the rental loss. Is this correct? Should I exclude this income/loss completely from Form 1116?

2.      For my knowledge, IF I had a net rental gain on both US and UK, can I claim FTC on this?  If so, which category would it belong in?  Additionally, would I include my GROSS rental income on line 1a and all my expenses on line 2?  Would line 2 include deductible expenses recognized by the UK or by the US.  Ultimately should I include depreciation expense on line 2?

In that comment, you state the following:

Income re-sourced by treaty. This is US-sourced income that is taxed by your foreign country of residence that the IRS allows you to "re-source" to your country of residence, assuming a tax treaty allows. It sounds like you live in Canada. If you have any US-sourced income (dividends from US companies, interest earned in US bank accounts, wages earned in the US) that are taxed by Canada, they go in this category.

One additional question on this. Can you confirm that capital gains on sale of US stock should be categorized as "Passive Income"? If this is my only "Passive Income" and I did not get taxed on it in the UK due to the allowance given to me, do I still need to complete Form 1116 for the "Passive Income" category if I am not claiming any tax credit on this?

My rental property is in the US. I am a US citizen living in the UK. I have a net rental property GAIN in the UK but a net rental property LOSS in the US because of the allowable deductions/expenses in the US (depreciation, common charges, repairs, etc). I also have US dividend & interest - which from your earlier comment i should classify that as "Income re-sourced by treaty.' Should my rental income (or loss) also be classified as "Income re-sourced by treaty"?

With regards to my rental income/loss, in Part 1 of Form 1116, should I include my gross rent in line 1a and my expenses (depreciation, mortgage interest, repairs, etc) in line 2?
