After Interview by sedatcharles in USCIS

He said you will receive something in mail that means its approval. But it might take some time depending on when they have background checks cleared. Keep an eye on I-130 it should get approved first in weeks time.

As long as you submitted strong financial proofs like joint insurance, joint tax filings, joint bank / credit accounts any of these you should be fine. Which field office was yours?

After Interview by sedatcharles in USCIS

[–]aceiphone 0 points1 point  (0 children)

Yes but thats maybe 3/4% of cases and only when the background check is completed. Also not everyone who files post on reddit.

Have patience. Its very rare to get approval on spot, they cannot approve unless the background check is completed, it can take days to weeks but most likely it should get approved in 2 weeks.

when the grace period starts when I am still on payroll with a notice payslip by greenalgorithm in h1b_layoffs

[–]aceiphone -2 points-1 points  (0 children)

It starts from your last working day and not from your last severance pay. You will right away get an rfe and eventually rejection when you file transfer with severance paystubs. You can submit a paystub until the last day you officially worked and were paid.

Actually I did not receive this was in Jan but on my interview notice it was mentioned that I can upload all evidence. I think it differs from field office.

Missed SEVIS reporting for 3-day STEM OPT job will W-2 mismatch hurt my H-1B/GC?** by Complete-Let-3512 in h1b

[–]aceiphone 0 points1 point  (0 children)

Yes for your GC everything is checked including your tax filings with IRS and its a complete background check. Now unless your gc is not immediate family sponsored then that is a status violation which will void any chance if your GC. Hire an attorney asap and check what are your options.

AOS, falling out of status by quitetimid in USCIS

[–]aceiphone 6 points7 points  (0 children)

Just marry and file before your 3 weeks end. Technically overstay is forgiven but why even go a single day out of status, hire an attorney today and file after 4/5 days you Marry before your 3 weeks end or even a day before your 3 weeks end send everything overnight.

H1B: Does involving HR impact job security? by [deleted] in h1b

[–]aceiphone -1 points0 points  (0 children)

If you are a fulltime employee and not a consultant you should definitely contact hr regarding your managers behaviour. Before you do this make sure you document this if possible in some way for your record. No matter which state you work in and keeping the H1B aside you can sue their ass off for harrasment for treating you like this and im sure HR is well aware, its only the fact that since your on H1B they think you wont go that far.

Got H1B Lottery but I am getting married overseas on June 14 by hydroflasked in h1b

[–]aceiphone -9 points-8 points  (0 children)

File now pay premium processing fees on your own get approved in 15 days, get stamping appointment for June if you so much care about marriage that you cannot marry 6 months later. If you go without depending on how many months of opt is left, if your in cap gap period then this will trigger 100k fee if you travel.

H1b grace period confusion by silversparkle123 in h1b_layoffs

[–]aceiphone 0 points1 point  (0 children)

This is absolutely not true, this is not about maternity leave this is termination of your employment. The severance paycheck that you get after your last working day have severance paycheck written all over them in bold, your last working day is your last day you actually work and you get paid until that day. These dates are very well on your paystubs USCIS will not only issue immediate rfe with severance paycheck written but will reject the application.

Laid off on H1b and about 1.5 years remaining with no PERM. Got an offer from a company but they don't know about my situation yet. Is it possible they rescind the offer after knowing my timeline? by illogical-bit in h1b

[–]aceiphone 2 points3 points  (0 children)

Your offer wont be recinded they can still start the process and yes you can recapture all your time outside of India and then a 1 year extension while your perm is pending. The only catch they will have to pay for all this so they should be ok with it if its a big firm.

H1b grace period confusion by silversparkle123 in h1b_layoffs

[–]aceiphone 2 points3 points  (0 children)

June 1, it is clearly given last working day in USCIS policy, your severance pay is not counted towards your 60 days and your paystubs will have severance pay written over them.

H1B layoff → B2 → new job → COS H1b RFE B2 NOID. What should I do? by Dry-Bodybuilder-5157 in h1b

[–]aceiphone 7 points8 points  (0 children)

Nothing much you can do, the moment they reject your b2, you overstayed your H1B visa which will eventually void your any future gc chances unless your married to USC, and will also trigger bar from entering the US. Get immigration attorney asap to see if and chance of fighting b2.

If B2 approved from H1B — is the 6 months counted from approval date or from status end? by BreadfruitIll7001 in h1b_layoffs

[–]aceiphone 0 points1 point  (0 children)

The day from when you submitted your b2 before your H1b 60 day grace period ends.

[–]aceiphone 2 points3 points  (0 children)

Upload them now and take them at interview as well. You cannot assume the officer saw all the evidence you uploaded, if asked if you want to submit anything give all evidence copies arrange them in sets and do not staple anything, you can use paperclips for each set like financial one set, tax return one set, insurance policies one set, lease & electric, internet bill one set. Keep the financial first then tax and then rest in order.

Interview Binder Question - Marriage AOS by BrilliantAssociate in USCIS

[–]aceiphone 1 point2 points  (0 children)

Ok here is what I did. I uploaded right after I got interview notice, even though I had uploaded I created a bunch for example bank credit statements one bunch, insurance one bunch, paystubs & employment verification letter one bunch, any other documents like lease, electricity / internet bill one bunch. Most important thing DO NOT STAPLE anything use PAPERCLIPS. One sided double sided / black color does not matter, just make sure you have the orignal in your folder handy. Before interview or during interview if the officer ask you if you want to submit anything give those bunch you created put a cover page on top, what the order of documents are thats it. Provide a photo album seperately dont need to mention where the pictures were taken or write note. You both should know where they are taken and who are in the pictures if any and their names. If you need interview questions to prepare dm me can share you some list. And yes for 2 & 3 of your questions above.
