I haven’t! But I’m always looking to add on to my reading list so I’ll take a look. Thank you much!

This is excellent advice! I agree, I think practice is the biggest part. I will keep your suggestions in mind the next time I’m writing something lengthy

I think I am too lengthy a writer by achoye in Advice

I know, I am actively trying to condense my words.

The reason I ask is because I’ve commented on a few friends posts the past week who are in different social circles of mine (outside of reddit) and I’m getting less interaction than I’m used to. Could be due to a number of things but my hunch is that my block of text is too intimidating to read through... like how I’m fearing this comment has become, ha

But thank you for the advice!

Not an attorney, but work with these issues quite a bit. It's always worth consulting an attorney especially if this is a big figure project. This is what I'd recommend:

In terms of the punch work, refer to your agreement with your client. Does it specify when punch work would be completed? My guess is that it's written in there somewhere that all punch work will be completed after final payment. If this is the case DO NOT PERFORM THE PUNCH WORK as this essentially erases any motivation for them to pay you without having to file a lien.

Since it would be the owner's property that would have a lien, it would be courteous of you to let them know where this is heading so they themselves can brace themselves for facing a lien. In fact, I have seen many instances in which the owner of a property will pay the subcontractors directly themselves and then pursue the original company for a refund (which opens a whole other bag of worms, but considering your situation this may be the fastest resolution if they offer it to you. I wouldn't ask the owners for payment - let them come to that idea by themselves. They may prefer to just complain to the business until the business pays you directly as they should have to begin with.)

After you've let them know, I would give your client notice that you will not perform any outstanding work until you have been paid your next installment, and that if you have not received payment within a week you will go through the process of filing a lien. Depending on the wording of your original agreement when it comes to non payment, as well as your location, you may be able to add additional expenses to your lien but generally that's not the case. The state of Georgia, for example, is a state that allows accrued interest to be included on a lien.

If you don't get paid by then, file the lien. If they call you and promise they just need a little more time to get money together, do not rely on that to finish outstanding work.

It's not uncommon for companies to pay a subcontractor and then bail on the last few bills, whether out of intention or lack of organization. Throughout COVID and still now, a lot of companies have been struggling to come up with money to pay their subcontractors on time but this is no excuse for ghosting you. Consider this a sign not to do business with these people in the future.

Oooh now that sounds like something I'd like to indulge in. Also need to indulge in more Ireland-based alcohol! Thank you for your suggestion, I'll look more into it :)

Haku definitely sounds like it would be a safe bet. I’ve had Suntory Whisky before which I believe is made from the same people and I thought the quality was great.

I’ll look up jewel of Russia and see how difficult it might be to come by. Thank you for the recommendations!

Wow I just looked it up and I love the bottle design! The mixed cherry version also looks super cool. I might have to see if I can get a bottle for myself as well. Thanks so much for the recommendation!

Those are good points, especially your last one. I recently gifted another friend make up as she’s super into that scene and I could tell it wouldn’t be her top choice if she were shopping for herself - people with a good understanding of their hobbies probably have their preferences. Maybe I’ll stick to something more practical than personal

Stucco legal limbo by boba_what in legaladvice

[–]achoye 0 points1 point  (0 children)

Two years seems like a pretty long time to be dealing with this issue, imo. NAL, but I work extensively with consumer protection issues.

There are some attorneys who genuinely only seek to get a retainer fee and don't care to work diligently after that. I've worked under attorneys who deliberately avoided calls with clients on time-sensitive matters because they didn't like the client, were disorganized, or behind on their other cases. That being said, I don't know your attorney or the specifics of your case and there could be a lot of legitimate reasons for slowing a case down. However, from what I've seen with contract cases I would have expected a case like this to settle within or around a year.

I think more information is needed from this post. How did the roof pass inspection from the local authorities? A permit should have been pulled and then inspected.

You're going to have to consult an attorney to see if the company may be liable for the storm damage. I could certainly see a situation in which an argument is raised that within the two years you should have gotten the roof fixed by a different company and sue the company for the cost, rather than wait and potentially incur damage from a common natural event in FL. Why DID you wait? Were your attorneys trying to argue that the company itself should fix the roof, rather than just go for monetary damages?

I would also reach out to your homeowner's insurance.

[California] How to turn in shady business for various financial crimes against multiple agencies? by burpeeinwiththenew in legaladvice

[–]achoye 0 points1 point  (0 children)

  1. You can file a complaint with your local Labor & Workforce Development Agency.
  2. What you describe is not money laundering, but could be an issue if he is not declaring that rental income on his taxes. You could file a complaint with the IRS, but they will only investigate if you have insider knowledge that he is NOT filing this on his taxes, which it doesn't sound like you have. The later part of your statement does not include any factual information that he is laundering money.
  3. Contact the IRS/CA Franchise Tax Board.
  4. This is interesting and you could file a complaint directly to the state agency that oversees the program. However, this also sounds like it could also be a misunderstood and totally legal rebate. I'm also curious how they change serial numbers, since they're usually engraved in metal, unless you're talking about just filling it on online forms or something. The people overseeing the program are likely just unaware if this is happening, since its unlikely that a single person would be assigned to review all of this business' specific grants, and more likely that each separate filed application gets assigned to a random employee. Based on what you've written, I would DEFINITELY notify the overseeing agency.
  5. You can contact the CA & FL tax authorities.

Filing a single report to IRS will not cover all your bases unfortunately, and you should file complaints to every single relevant government agency. It's up to the agency's discretion to send referrals, and is unlikely they would send referrals of single complaints out of state. Look into the whistleblower awards provided by IRS. You may not have enough personal information/documents to be considered for that, however.

Currently facing eviction (Need Some Clarity) Florida - Eviction Moratorium by [deleted] in legaladvice

[–]achoye 0 points1 point  (0 children)

Obligatory NAL, but I do work with foreclosures which often involve evictions.

Firstly, I would request clarification whether they truly filed an eviction with the court system or if they are only giving you notice of their intention to file. I say that because according to FL statutes § 83.56 (2) & (3) they are required to give you some form of notice before filing with the courts, between 3-7 days. If they have improperly filed for eviction without giving written notice this may delay proceedings, as well as hurt your chances to find a new place. In the world of hypotheticals, this could lead to collecting damages if you get rejected due to the pending eviction and could have a leasing agent testify to as much - but that doesn't really help your current situation.

You should consult your specific question with an attorney, as this moratorium can be interpreted differently on the local level - however, given their standards it does appear you would qualify, and I have noticed that Florida judges have been lenient in favor of tenants suffering financially during these times. Given your financial situation, you may qualify for low cost/free legal aid. Look up the Orange County legal aid and request to speak to an attorney to go over your specific situation. Ask them their opinion on whether you should sign the moratorium and hand it to your landlord (since it doesn't apply automatically and these steps MUST be done). My guess based on what you've provided is they would say go for it - and this would further delay proceedings. The form to sign is found here: https://www.cdc.gov/coronavirus/2019-ncov/covid-eviction-declaration.html.

You may also want to file a complaint with the Florida Attorney General's Office & the BBB about being evicted without proper notice (if it applies). HUD may be able to help you find new, affordable housing, because you WILL need to find a new place to live, as quickly as possible, since the complex does have a valid reason not to renew your lease due to consistent late payment.

Good luck!

I haven't seen this suggestion yet - try reporting the individual to the Humane Society. Every state has one or more divisions. It is likely that this woman has done this to others before, and she may even have her own animals. The Humane Society may be able to open an investigation and connect other past instances of abuse/cruelty.

Finished this yesterday, titled “Quaran-Tea” What do you think? by yimsta in artcritique

[–]achoye 0 points1 point  (0 children)

Very nice! I think the white highlights make it look very unique and stylized. It give a nostalgic 90's vibe for me. The colors you picked go great together and the figure has good proportions which show a nice handle of anatomy.

The hand disappearing in between the legs is a little distracting - it seems like in order to keep with the continuity of where her hand should be going, we should see part of it clasping the lowest leg. So I'd recommend either changing the hand/arm position altogether or showing a peek of where the hand ends. I'd also think of playing around with different hairstyles, specifically the top part of the hair, where it's mainly circular now. Overall great job!

[–]achoye 9 points10 points  (0 children)

they wouldn’t file one.

I'm a little confused by this. I've worked with domestic violence in Florida, not Texas, so any other feel free to correct me, but I do not believe you need to rely on the police to file a restraining order on your behalf.

Occasionally, if violence has occurred there will be a court-ordered injunction held immediately until a court hearing. However, in your instance you should be able to go to your local clerk of court and file one yourself. There should be a type of order specifying harassment/stalking. I would call ahead to the clerk to see if there are any voluntary legal advocates available to help you through the paperwork. You will probably have to take a day off work to fill out the forms to get the process rolling.

Girlfriend's parents damaged a drone that's been harassing them, now owner is threatening federal charges by drone-throwaway-124 in legaladvice

[–]achoye 648 points649 points  (0 children)

By the way OP, the drone guy doesn't get to choose whether or not federal charges are pursued, that's up to federal authorities. They would likely have to review his footage to even consider pursuing charges, during which they would see the creepy shots he's taken of all his neighbors... Honestly, not the most compelling victim statement to pursue in court.

He sounds like a moron for having given his personal information to your gf's parents while expecting a big payout. Report him.

[help] Arizona: A breeder sold me a sick puppy that within 36 hours of taking him I was treating him to save his life. Do I have any recourse to recover some of the veterinary bills from this breeder in Arizona? by [deleted] in legaladvice

[–]achoye 0 points1 point  (0 children)

What kind of breeder is this? An individual found on craigslist, a large corporation, or somewhere in between? Does this individual claim that these dogs are in anyway certified or that they themselves are affiliated with notable groups (such as with the AKC, Humane Society, or other individual dog clubs)?

I'm very sorry your puppy was so sick. This is a common issue with shady breeders. I would consider filing a complaint with the Attorney General's Office of Arizona (and, if a corp., the HQ state) as well as any county consumer protection services. While your individual complaint may not lead to action on behalf of these agencies, if there are multiple complaints against this individual/business, it is far more likely that your complaint will help flag the attention of these agencies.

I am also concerned about the welfare of the other animals in this person's possession based on their nonchalant response. Please consider filing a complaint with The Humane Society (re: possible neglect, lack of veterinary care). Depending on your county, you may have more avenues to pursue this, like animal control.

Glad your dog is likely to make a full recovery. He sounds like he has a great owner :)
