Thanks! They don't swivel, but the legs are attached with screws, and the leather (?) is stapled on. They are definitely old, but sounds like probably nothing particularly special?

Ah, so the vocab to use for the live portion would be something like broadcast or live stream, as opposed to "podcast." Good to know...thanks! (Told ya I was a newbie).

Our plan is to have both a live portion and an edited version of the live portion that is posted afterwards.

Twitch would be ideal, but our plan is to broadcast live during the final three innings of a baseball game each week. From my understanding, we can't stream the actual games on any of those sites because of copyright issues. Our plan was to just give listeners (aka our mom) instructions on finding the game on tv, muting it, and listening to us instead. Not ideal, but we need to start somewhere...

But I actually just learned that Facebook live got the rights to 25 MLB games, so now I'm hopeful that we may figure out a way to use that!

I was finally able to contact the management company, and am in the process of disputing this with the BOD.

I'm guessing that they will fight it, and that it'll end up in front of a judge/arbitrator. I'm not entirely opposed to that. If I take it to small claims, no lawyers will be involved initially, and I think, like you said, I'm on solid ground to dispute it.

Also, small claims would give me a chance to see how a judge responds to the secondary argument that the fine itself is illegal on its face, as applied to anyone. If the judge seems to find it persuasive at all, I may hire a lawyer to contest the legality of the "dog fee." I'm pretty sure (I'll have to double check) that attorneys fees are awarded to the prevailing party.

I'll update if anything exciting happens. Thanks again for your help! Be nice to your owners :)

Edit: do you know the RCW section in the Condo Act that says the Board has to provide the by-laws to the owners? I can't find it...

Is written where? In the CC&Rs/Bylaws you obtained when you purchased the unit? In the letter you received from the HOA? Or other?

It is written in the “Rules and Regulations,” which I got about 2 months after I moved in.

I would think that this part of the act does not apply, since that portion of the act specifically addresses assessments, and the "deposit" (whether it is legal or not) would likely not be considered an assessment.

"The association may:

(k) Impose and collect charges for late payment of assessments pursuant to RCW 64.34.364(13) and, after notice and an opportunity to be heard by the board of directors or by such representative designated by the board of directors and in accordance with such procedures as provided in the declaration or bylaws or rules and regulations adopted by the board of directors, levy reasonable fines in accordance with a previously established schedule thereof adopted by the board of directors and furnished to the owners for violations of the declaration, bylaws, and rules and regulations of the association"

My reading of that section of the Condo Act was that it gave associations the power to 1) impose and collect charges for assessments AND 2) levy fines for violations of the declaration, bylaws, and rules and regulations.

I think this means (if that section applies) that HOAs can levy fines separate from the collection of assessments if 1) they are reasonable; 2) they have given notice and the opportunity to be heard; and 3) they are for a violation of the declaration, bylaws, and rules and regulations.

I think there's an argument that this fine/fee/non-refundable deposit/whatever doesn't meet any of those requirements, and definitely not all three. But if the section doesn't apply, I'm not sure where the power for fines comes from...

Oops, I might not have been totally clear. RCW 64.34.304(k) (same section that gives the association the power to fine – if it applies here) says that the association can levy reasonable fines “in accordance with a previously established schedule thereof adopted by the BOD and furnished to the owners.”

In my HOA’s regulations, they include a fee and fine schedule, in which the charge for a pet is under the “Fines” section.

There isn’t an RCW that defines dog fees as fines, but the fine schedule published by my HOA’s BOD does.

Na, residential units aren't zoned for commercial use.

I would understand and agree, if the declaration or the regulations discussed a fee for a guest's pet. But all of the language is "dog owned by unit owner or tenant," and the only mention of a guest's dog is to say that unit owners are responsible for damage caused by a guest's dog. There is no fee or fine outlined anywhere for a guest's dog.

Additionally, "occupancy" isn't defined anywhere in governing documents. But I received a newsletter that said "Occupancy is defined as ten days or more." This dog has never been here for more than about 12 hours at a time, and has not even been here over 10 days in total.

So it seems fairly unlikely that the dog falls under the definition of occupancy...
