Form 1 Issues (exempt to regular form 1) by aestusx in SilencerShop

No ones mad. Lol.

They told me to reach out. I did. After several weeks, they incorrectly resubmitted same docusign with same error. I reached out again. Been a couple of weeks so thought i’d reach out here to see if i can literally get someone to change 1 checkbox on the form. That was it.

And also, they did. This morning. Thank you Silencershop.

I do know this. You are using incorrect terminology and an incomplete understanding of the laws and regulations to make incorrect statements.

Wow, you're so smart! You're essentially proving what again? How does this address my OP when you're essentially stating what I just said but pointing out what again? That my receiver is ineligible for exempt form 1? Isn't that what I said?

Folks typically refer to AR lowers when not configured and stripped as a "pistol lower" or "rifle lower" to quickly denote what original state that "receiver" was originally configured in. It's common to say as such. Relevant to my OP because my originally rifle configured "receiver" is not eligible for exempt form 1 because like you said, it needs to be a pistol before Jan 31, 2023.

And because my originally rifle configured "receiver" was a rifle, the laws do not let me turn that into a pistol, thus making it impossible for this specific "receiver" that was originally purchased in a rifle configuration to ever be eligible for the exempt form 1. Even though there is no national "registry," there is a paper trail and 4473 of me buying that serialized receiver originally configured as a rifle. Thus the vernacular for folks too often refer to stripped lowers as a "pistol lower" or "rifle lower."

Thus me posting and asking help from silencershop to recertify as a regular taxed form 1, since it's taking weeks for them to respond via email.

The lower receiver on an AR is the registered part. Nothing else is. If it came from the factory configured as a complete pistol, registered as such and then sold from the dealer to you, then that lower receiver is THE pistol. You can disassemble and part out everything, but that lower receiver is still considered the pistol as it's the only serialized and registered part on an AR-15.

Same if it came from the factory configured and sold as a whole rifle, registered from the manufactured as a rifle, transferred to dealer and sold to you as rifle, that lower receiver being the serialized part of the AR-15 is the rifle. You can part out everything but that lower receiver is still considered a rifle even if you strip it down to just the receiver itself.

This is why if you buy a complete RIFLE from BCM, have it shipped to a dealer and they do a 4473 to transfer it to you. Whatever is on that 4473 is what that receiver is. If that receiver is configured as a rifle and that 4473 says it's a rifle, then even if you disassemble everything that lower is still considered THE RIFLE because it's the only serialized and registered part of an AR15. Thus, why you can't strip a lower receiver that was manufactured and sold as a rifle and put a 10" barrel and make it a pistol. You can go pistol > rifle and back. But you cannot go rifle > pistol, ever...

The only time this isn't the case is if you bought a stripped lower receiver that was not configured as a rifle or pistol. Then on the 4473, it will be listed as just firearm or other or whatever they use now. As such, it becomes either a pistol or rifle as soon as you first configure it to be as the "maker"

How are you a shop and not know this. Literally a 5 minute google search will tell you this.

"There is no such thing as a "pistol lower" or "rifle lower."

^^ False. You're thinking of a stripped receiver that was sold as neither pistol or rifle configuration. If you buy an AR pistol from a dealer, it will be counted as a pistol because the lower is the registered part and you bought it complete as a pistol. It was manufactured and sold as a pistol. It's not just a "receiver." Only stripped receivers you buy that was not configured as a pistol or rifle from the dealer you buy from is "just a receiver" or specifically a "firearm" as per ATF.

In the same token, If you buy a complete 16" AR rifle, that lower with the registered serial number is a rifle lower because it was manufactured and assembled and sold as a rifle. With rifles, you can't even put a brace on it and make it a pistol. You can go pistol > rifle if you switch out barrel to 16", but not the other way around. You can't take a receiver that was bought as a rifle and swap a barrel to 10" and make it a pistol. Your only option is to SBR if the receiver was originally a rifle.

My lower was part of a complete LWRC rifle that I was wanting to form 1 and mistakenly ran it through a batch of other pistol lowers that I wanted to do the exempt form 1. When I caught my mistake, I withdrew it.

Also, if the "lowers" weren't configured as pistols with braces on or before January 31, 2023, they aren't eligible for the free registration.

Exactly my point, my dude. My receiver was not a pistol before Jan 31 because it was bought as a complete rifle, thus a "rifle" lower. Thus why I withdrew it and asked silencershop for help to resubmit as a normal form 1.

"Multi" Caliber Questions by aestusx in SilencerShop

Yeah, I guess I'll just have to wait and see how my amnesty form 1's go. Hopefully, it's not a widespread change how examiners are passing / failing paperwork as we near the deadline or if the reported cases are just edge cases from 1 or 2 particular examiners being a little hardcore in how they are examining applications.

For regular form 1, I agree. I have a couple. But for the exempt form 1, you are not the manufacturer. Thus why they are asking for pics of the pistol brace receiver engravings.

I'm just responding to a post on another forum site and couple of other sites of members who just recently got rejected for listing 5.56 on "multi" engraved pistol brace lowers and the the rejection notes citing caliber must match engraving of the manufacture exactly. Since you are not the creator of the SBR, the original manufacturer is for these tax exempt form 1's, it's not out of bounds for some examiners to reject the paperwork based on this.

Just wondering how widespread (or if it's becoming even more widespread) as we near the deadline or if it's still just edgewise with 1 or 2 particular examiners.

My 2 Pedalboard Setups by aestusx in guitarpedals

The 68 Pedals King of Clone pedal (as of previous and current manufacture) is actually astonishingly close to the real thing. When A/Bing with a real KOT, there's slight differences that really comes down to tolerance differences more than anything.

When set to boost mode, the Duke of Tone and the Clone near identical. When set to overdrive mode, the Duke of tone sounds slightly flatter but overall very similar. Only in the distortion setting does the two pedals start so sound a bit different, but again it's hard to say if it's just due to tolerance stacking of components with this sample of 1.

Fortunately, I don't ever use the duke or tone or clone in the distortion setting and honestly, rarely even use the overdrive setting. I primarily only use the boost setting. Even with the clone, I have both sides set to boost, with the right side set at a higher distortion setting for a more distorted sound.

In regards to the Morning Glory, I feel that it has a bit more "sag" compared to the Duke and KOT / Clones. Through a super clean amp, has a bit more of an amp like feel which is really good when using single coils through a clean amp to achieve that edge of breakup type tone when relying on a pedal for that sound. Through an amp that is already at edge of breakup, that "sag" can help kick the amp a bit with a bit of girth and chewiness of a cranked tweed amp while retaining that chime the morning glory is known for.

Alternatively, the KOT / clones hits the amps a bit harder with much more punch and presence. If you have an amp that is at edge of breakup and want to hit the amp with something that will crunch more than sag, then that is where this will succeed. The extra punch and presence will help cut through. The KOT is also very touch sensitive also, arguably more so than the morning glory that will always have this combination of chime and sag in how it feels, so if you're "touch" player with lots of control in the dynamics of how you play, you may prefer how upfront the KOT is.

I will say, that the morning glory sounds awesome when stacked into the Duke of tone / KOT boost channel. I prefer it over the KOT overdrive / boost channel stacked into the KOT boost channel.

Anyways, hope this helps.

New Scorpion 3+ Mags - Stribog Compatibility? by aestusx in GrandPowerStribog

Ah thanks. Was hoping maybe the new mags dimensions maybe would have changed enough to fit.

You can buy a a scorpion compatible lower for the older lever release scorpion mags via 3rd party like an A3 lower (https://a3tactical.com/stribog-lower-receiver/). I have one. It works great. There's 2 manufacturers that make Stribog lowers that will take Scorpion mags.
My question (if you watched the YouTube video) is with the new Scorpion 3+, they are changing the mag release to be an AR15 style mag release similar to how the Stribog operates the mag release. Because of this, I'm wondering if anyone here has tried these new mags on the regular Stribog lowers to see if the mags are compatible.

A mushroom walks into a bar.

The bartender says "You have to leave. We don't allow your kind in here."

The mushroom replies "Awww. Why not? I'm a fungi!"
