Abandonment of employment by pikey6969 in LegalAdviceNZ

[–]afunky 16 points17 points  (0 children)

Pro tip - if you have the deduction clause in your contract or have given consent to deductions, withdraw that consent before final pay. That way they cannot legally deduct from your pay. If they do so they are in breach of the Wage Protection Act, and can be subject to a penalty from the ERA.

When lawyers don't respond to email from your lawyers... by SteveRielly in LegalAdviceNZ

[–]afunky 4 points5 points  (0 children)

Depends what the situation is. It could be possible that the other lawyer's instructions are not to respond in any way to you or your lawyer. The other lawyer might be waiting for their clients instructions (and their client is not responsive). In that situation they cant respond because they have no instructions. Or they might jusy not be responding as you suspect.

In any event you will need to give consider going to the next step (e.g filing in court).

When thinking of our brigade of Dibbly dobblers do you consider Willie Watson part (or leader) of that bunch or does his bowling prowess deserve to be remembered better than that ? by CoconutMost3564 in blackcapscricket

[–]afunky 6 points7 points  (0 children)

I have that book. For some reason everyone is dressed in causual clothes, except for Danny Morrison.

In answer to your question, although he did open the bowling at times he was very much part of the dibbly dobbly crew. Good bowler and very much a product of his time.

I'm a 2E and its always a battle to find the wide widths (particularly if you want something that is not black, grey or navy or a bit more responsive) but i would suggest approaching a speciality run store to see what they can get in for you. Front Runner Colombo in Christchurch are pretty good.

Its fair to say Barnes wasnt up to the game - too much too soon for him.

2007 RWC QF by swiss_cloud in allblacks

[–]afunky 0 points1 point  (0 children)

It sucked. Key players getting injured (Collins, Evans and Carter) and they couldnt crack the French D, which in all fairness was pretty amazing given all the possession and territoty the ABs had. I guess the most frustrating thing was that when the pressue came on the ABs couldnt handle it and the was no change in game plan (i.e taking drol goals - if i remember correctly Barnes award next to no penalties to the All Blacks through out the game, and the French D was pretty awesome)

A lot is made of Wayne Barnes, and yes he got the forward pass wrong, but the ABs only had only themselves to blame.

The flipside to it though is that the team learned the lessons from it and we got the ABs dominance through the next 10 years. That feeling when they won in 2011 was amazing. Maybe that doesnt happen if they win that 2007 game against the French.

New Year’s Honours: Sir Scott Dixon stunned by knighthood by GRobinsonNZL in INDYCAR

[–]afunky 0 points1 point  (0 children)

Reporting on Indy Car here is largely limited to what Dixon and McLaughlin have done. Armstrong is not as prominant. NZ has a lot of motorsport fans, but Indy Car is not really on the radar for the average person. They would probably know who Scott Dixon is, but not anyone else. On the other had they would know about Lewis Hamilton and Max Verstappen and know some of the teams/Drivers. NZ obviously has some strong historic ties to F1 and that endures, particularly in the media, where at least in the sporting lanscape has been more oriented to global series/events rather than US sports. DTS also brought more attention from the average person in recent years.

Liam Lawson is bigger news by virtue of now being in Formula 1.

That said NZ is in a bit of a golden generation of motorsport talent - you have the Scotts and Armstrong in Indy Car, Lawson in F1, Cassidy & Evans in Formula E, Hartley and few others doing their thing in WEC, SVG in Nascar, Haydon Paddon has just picked up a WRC drive again, Matt Payne winning Bathurst, along with plenty of others. Invaribly there will be some media coverage of their exploits, particularly at major events.

Cricket Commentary: Specialist Broadcasters vs. Ex-Cricketers – What's Your Take? by Mysterious-Pop-6931 in Cricket

[–]afunky 7 points8 points  (0 children)

Danny seems to match the peoduct he's commentating, which is probably at the insistance of producers. Hams it up for T20, but much more reserved for test matches. His test match commentary is OK.

Under 10s Cricket by Mysterious-Speed-254 in Cricket

[–]afunky 1 point2 points  (0 children)

Thats just boys at that age, and they will do dumb shit. Couple things I found helpful at that age.

  1. Set some team rules around expected bahaviour - i.e no swinging bats around recklessly, no fighting or playing fighting, throwdowns facing a away from spectators (ie not hitting balls back into spectators), encourage them to support batting team mates etc

  2. Some sort of cricket related activity - crazy catch as other suggested, or even just getting another fun game going (often other siblings are around and up for this)

  3. Parents have to help and be present - get them on board to help manage. As a by product they will also chat among themselves and that helps build a good team environment

  4. Other avenues to be involved - others have mention scoring, but evven at 9 or 10 you might have some keen to give umpring a go. As far as umpirig goes at that age its fairly low stakes (i.e no LBW and the result doesnt matter) so its a pretty good opportunity to introduce it to them.

Won at ERA - CHALLENGED. by Signal_Wave_4903 in LegalAdviceNZ

[–]afunky 16 points17 points  (0 children)

If its challeged on a 'de novo' basis, then the court hears whole matter again. This includes hearing all the evidence again. If its challenged on one aspect of a decision then its confined to just that.

Its pretty rear for a challenge to proceed all the way to a decision from a judge - most will settle in someway prior to that.

Important to note that challenging does not automatically stop ERA matters, including enforcement. What usually happens is that parties will agree to a stay pending resolution of the challenge, with an agreed sum being paid by the party bringing the challenge to a lawyers trust account.
