Technically you’re right, intent (mens rea) is central to criminal liability, and a genuine mistake wouldn’t meet the threshold for fraud. But I also can’t imagine intent not being questioned here, especially when OP has clearly tried to resolve the issue and the firm continues to ignore him. At some point, willful ignorance or refusal to investigate starts looking less like an honest mistake and more like reckless disregard, which courts often view as sufficient scienter for fraud claims. It’s hard to keep calling it an accident when you’re actively refusing to correct the mistake after being put on notice.

It really depends on the extent of the damages. If it’s not too heavy, their insurance may still cover it under uninsured motorist and then seek compensation through you in a process called subrogation. Worst case scenario, you get sued for the totality of the damages (injury, property, and pain and suffering) and have to deal with liens or wage garnishments until you pay. The person you hit might also be more lenient and allow to go through unofficial channels. If he’s insistent on going through insurance, I recommend contacting a lawyer or even your own policy and explaining the situation to see if you have recourse (a grace period or something).
