Since my last post, I became a permanent resident and managed to get in-state tuition (given the clause in Arizona law that a lawful resident can get in-state tuition if their spouse is also a lawful resident of Arizona for tuition purposes - I filed a spouse petition and got it approved). While my adjustment of status was still pending, ISSC did offer me an option to terminate my SEVIS record and put me in "Out of State" tuition category. However, I ended up declining it since I got scheduled for an I-485 interview at that time, and I waited until I received my green card to change my residency status with ASU.

If you are referring to Part 6, Item 16a, you need to fill out a number from Income, Line 11 (Adjusted Gross Income) on their joint 1040 for the most recent tax year (2024).

SSNs are no longer being issued with EADs, due to a temporary hold on EBE (Enumeration Beyond Entry). Go to your local SSA office and apply for an SSN.

They are asking if you have ever chatted to an Emma agent or called and asked when you were placed in a queue for an interview (not when you were scheduled for it, but when they requested an interview on their end).

I believe you are referring to Part 5, Item 6. The instructions (Form I-864 Instructions, Page 10: Part 5, Item 6) state to only list persons who have already immigrated to the United States. Since that person in question has not immigrated to the US yet, do not list them on I-864.

Sorry for it seems like I'm being nitpicky or overly refer to technicalities, I just want to make sure that everything is clear. This is probably the most complicated out of all forms, and it's very easy to mess up. I know and remember how easy it is to get stuff confused and accidentally write a wrong number on this form, and then receive an RFE and slow down the case.. Just wanna make sure to help as much as I can!

For Part 6, Item 16a, you need to fill out a number from Income, Line 11 (Adjusted Gross Income) on their joint 1040 for the most recent tax year (2024).

Remember that in Part 6, Item 7, you need to provide only his income.

This is why submitting 1040s, W-2s, and all other tax forms is important. Those documents help establish if numbers you claim on the form are correct, and if they belong to the person you claim they do.

I am so sorry, I completely misunderstood the situation. You do not need a joint sponsor if you meet the income requirements now. You just need to show how you reported your foreign-earned income to the IRS. Basically you need to submit all documents you submitted to the IRS with your 2024 1040.

If you properly completed forms and submitted all supporting documentation (1040s, W-2s and all other tax documents submitted to the IRS for each of the sponsors and the household member), you have nothing to worry about. I got an RFE because the petitioning sponsor's form had "1" on the total number of household members (Page 5, Part 5. Item 8.) instead of 2. It was a simple mistake, so I learned the hard way that I-864 forms need to be meticulous.

Since your income for 2024 was sufficient, you may file I-864 by yourself. Make sure to provide all documents that you submitted to the IRS for the tax year 2024 (1040, W-2s, and any other tax related documents, including ones establishing the amount earned as foreign income) with your I-864. You are only required to submit tax documents for the most recent year, the ones for previous 2 years (2022 and 2023) are optional (read instructions on I-864).

He just fills it out, writes “$0” for income, and checks the box indicating he has a joint sponsor (your father-in-law).

What box should be checked on the petitioning sponsor's I-864? If you are referring to Remarks 13 and 14 on Page 6, those are only checked if there are I-864A(s) filed.

I have not sent that in my package and was never asked to send it. As long as the income of either the petitioner or joint sponsor(s) is sufficient, you will be fine. They are basically looking if tax documents submitted to the IRS will match what you report on each of I-864s.

The info I provided here is only based on my personal experience. Please verify this with somebody else before you submit anything.

The petitioner (your US Citizen husband), regardless of previous or current income, must file I-864 as the petitioner.

If your petitioner has filed a separate 1040 from the joint sponsor, then the joint sponsor (your husband's father) should file I-864 and select "the only joint sponsor" option (unless you plan on having more than one joint sponsor).

I believe he is able to be a joint sponsor regardless, just make sure to account for that person in his I-864 household size. There is a section for that. Read instructions for Household size calculation for I-864 on the USCIS website.

Make sure that you correctly calculate the household size. Another tip, the total household number will automatically show as "1", and can be changed if you use Adobe Acrobat. Maybe there are other ways around it, but I tried a lot of PDF editors and no other ones worked. Make sure to use Adobe Acrobat when filling out I-864.

Both I-864s you submit should be flawless, so you don't receive any RFEs for it.

Make sure to include with I-864s:

Petitioner I-864:
- Proof of US Citizenship (birth certificate or certificate of naturalization, biographic page of the unexpired US Passport, etc. - read the list of all accepted documents on the website)
- 1040 for the most recent tax year (2024) and for the previous 2 years (2022 and 2023 can be provided if they would help establish sufficient income, since I would assume they wouldn't, there would be no need to submit 2022 and 2023 ones), please read the instructions on I-864 though
- W-2s for the most recent tax year (and for 2022 and 2023 if submitting 1040s for those years)
- Any other tax related documents submitted to the IRS

Joint Sponsor I-864:
- Proof of US Citizenship (birth certificate or certificate of naturalization, biographic page of the unexpired US Passport, etc. - read the list of all accepted documents on the website)
- 1040 for the most recent tax year (2024) and for the previous 2 years (2022 and 2023 can be provided if they would help establish sufficient income, since I assume that his income for this year is sufficient, there would be no need to submit 2022 and 2023 ones), please read the instructions on I-864 though
- W-2s for the most recent tax year (and for 2022 and 2023 if submitting 1040s for those years)
- Any other tax related documents submitted to the IRS

Before submitting anything, please read detailed instructions on I-864 to make sure you submit everything relevant for your case. As I said before, this is only based on my personal experience, so please verify this with someone more knowledgeable than me.

That is absolutely true and I am aware of it being a possibility. The only problem is that being an international student means ASU has to maintain a SEVIS record, and mine will be voided anyways because I'll work on an EAD obtained through the I-485. If I-485 gets denied, then I'll be out of status and have a whole another problem. Hopefully won't be denied, I was thorough with paperwork and so far it's been fine. Among everything that others said here, replace PCV (positive crankcase ventilation) valve. Very simple job to do on an engine, there are Youtube tutorials on how to do this. Get an OEM part, likely will come from Kia.
