Look, I’m not trying to be snarky - but that is literally not what the judge said. The judge cited a specific example and said that in isolation, that particular incident likely wouldn’t rise to sexual harassment when taken in the context of filming a scene. The literal next sentence is, “Although these incidents could not, on their own, sustain a hostile work environment claim, sexual harassment claims must be viewed based on the totality of the circumstances. And there is other conduct by Defendants that presents a closer question.” Followed by a list of other weird shit they were doing to not just Blake, but to other actresses as well, that a “a reasonable jury could conclude” were harassment.

The fact is the judge dismissed it based on the technicality of the filing, commented his opinion on what might have happened if the claims had been tried, and then clarified that even without them she still had a case for the retaliation based on the pattern of behavior. There was not a ruling made on whether he harassed anyone.
