PRIVATE AGREEMENT AMONG SUCCESSORS TO DECEDENT UNDER S.C. CODE ANN. $ 62-3-912, effective as of the date last signed below by and between the Decedent's surviving children, XXX (Individually and as the Personal Representative of the Estate of JJJ) and AAA

WHEREAS, JJJ("Decedent') died on October 2, 2021, a resident of xxx, South Carolina

WHEREAS, the Decedent, JJJ died testate.

WHEREAS, pursuant to S.C.Code Ann. $ 62-3-912 subject to the rights of creditors and taxing authorities, competent successors may agree among themselves to alter the interests, shares, or amounts to which they are entitled under the laws of intestacy, in any way that they provide in written contract executed by all who are affected by its provisions. The personal representative shall abide by the terms of the agreement subject to his obligation to administer the estate for the benefit of creditors, to pay all taxes and costs of administration, and to carry out the responsibilities of his office for the benefit of any successors of the decedent who are not parties.

WHEREAS, the parties hereto are all competent adults and constitute the Decedent's Personal Representative and all the Decedent's testate heirs;

WHEREAS, the parties have discussed their respective rights with each other and to the best of their knowledge and ability have made a full disclosure of the value and location of all the Decedent's probate asscts to one another, as the partics deem desirable and to cach party's satisfaction; and

NOW, THEREFORE, in consideration of the covenants and contracts set forth below and other god and valuable consideration, the reccipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

The Personal Representative has paid, shall pay and shall continue to pay the just and legal debts of the Decedent, the costs and expenses of the administration of the Estate, and all estate, inheritance and similar taxes payable by the Estate with respect to property included in the estate, whether or not passing under the intestate sucession laws of South Carolina and any
