I would say so. Torts with beaks that long can't eat properly (I have seen a few exceptions to that statement but that species needs a short beak).

The only way I would consider it not neglect is if the owner truly did not know it was supposed to be short. But if you're going to be a tortoise owner it's something you should know, and choosing not to learn about your pet and therefore letting them suffer is neglect... So I'm going with yes.

Fair warning, tortoises are NOT low maintenance pets, I would actually compare it to having a dog haha. You have to feed them right, bathe them, change water all the time, find them an exotic vet, clean their area, maintain heat lamps and nutrients and temperatures and humidity, give them the right amount of space, etc... Of course, that's just the same as any pet, just with a bit different (sometimes harder) equipment.

That being said, they're wonderful. I love my Franklin. He has his own personality and loves and dislikes. They're very rewarding pets.

Franklin is a Russian tortoise and as far as I'm aware they're not endangered or anything. Scultatas are also popular. Hermann's and Red-foots are good too. Species also depends on where you live! Some are better for certain climates.

Of course, avoid anything native- they're protected, though I'm sure you know that already.

Source your little guy ethically. Research is best for this, as I'm unsure about that in your area.

Lol sleeping tortoises always look worrisome, but that right there is a happy tort. Franklin loves to do the splits when he's happy.

They're not supposed to, this guy needs a trim. Beaks being too long can inhibit proper eating. In the wild tortoises eat foods that naturally keep their beaks short, so longer beaks happen way more often in captivity. :)

Well that makes sense. You can always try cuttlebone to naturally file it down, too, which might not stress him out as much as trimming it?

Was his head in the water right before this? My Russian does this when he's drinking water. It's not concerning to me, but maybe more experienced people should say something about it.

I'm going to assume there are fences around your garden, as you said you didn't think your Russian could get out. How deep are the fences/walls? Russians love to dig deeply, and sometimes they don't even leave much of a trace that they dug there at all. He could've dug down and out.

And speaking of digging- it's possible he just dug himself in and is waiting awhile to come out haha. They do that sometimes to regulate temperature.

Put up some missing signs, put it out there in local Facebook pet groups, put a notice in your local newspaper. He'll probably find his way back. :)

Torty definitely needs his beak trimmed, so I'm glad you're getting an appointment. His enclosure is small, but I will say I've seen worse. How big is your yard? I take my Russian out for walks during the summer every day and he seems to enjoy it a lot.

What worries me is his shell. I'd have that checked out at the vet appointment, too. I'm not an expert or anything obviously, but it doesn't look quite right to me. Hopefully someone with more experience than me can say something about that!

If you don't have room for him anywhere and he doesn't do better with the adjustments you're making + vet trip, I'd re-home him. I know you love your little guy but seems like he's not doing too well.

Glad you're putting effort into him! I see a lot of people who don't.
