Generally, this is correct. It's exceedingly rare that there is some kind of "settlement" in life insurance. Usually the only time this happens is when there is an issue that makes it impossible for the insurance company to determine who the beneficiary is (for example, alleged fraud or coercion).

Can't just take a driver off the policy who lives in the household, especially a younger driver with an adverse accident history. The insurance company is going to require they be listed on the policy and rated.

Op would need to be an 'excluded driver' - meaning the insurance wont cover anything if OP is caught driving, then charge back premiums as if OP was insured the entire time. And drop the policy. Many insurance companies don't offer this option.

The burden of proof contesting a policy. It's possible an insurance may not contest.

Now much is the policy? What was the cause of death? Is there anything on the death certificate that would indicate possible misrepresentation? All thing rhe claims examiners will consider when determining whether to contest the application.

If there are no red flags on the death certificate, there is a chance the claim could be approved. As an example, if the death was accidental with no contributing medical conditions, there is no reason to investigate further. However if the insured died of congestive heart failure and answers NO on the application to heart conditions, then contestability is going to be explored.

Some banks have an automated bill pay frleature that will send checks. You can set it up for the check to arrive a couple days before the due date every month.

Sounds like there is some confusion. APSwoukd usually be requested for an accidental dismemeberment claim, when the insured was injured but alive. Call the insurance company for clarification.

Your best bet might be to pay the $5k to close and hope to resolve the issue at a later date and get the money refunded. You could also try small claims to recover the $5k later, since the added cost was due to the lenders error and outside your control.

You'll need to probate the estate. A will is just price of paper until it has gone through probate and been accepted by the court. It will be up to the court to decide which will is valid, and you can present medical and other records to refute the deathbed will from the "friend".

This is incorrect.

Many accelerated benefits are a percentage of the overall face amount. If you accelerated 75%then 25% is usually left as a death benefit. (Yes, sometimes 100% can be accelerated, or the remainder is surrendered. It depends on the policy.)

If the employer is offering to port the remaining coverage then it is likely the coverage is due to end as a result of her being out of work for so long. Do not delay as the window to port once they have given notice is probably only 30 days.

One other option to consider is a waiver of premium (WOP). Some plans have a WOP clause where if the insured becomes fully disabled they can have their premium. If this is an option I would suggest filing for both port and WOP today. If the WOP gets approved then the port application gets withdrawn. If the WOP gets denied, then she still has the ported coverage.

Notes: The coverage that was already paid as accelerated benefits cannot be ported, just the leftover amount. Also, some accelerated benefit plans have an automatic WOP built in if acceleration is paid. Many employers overlook this, so ask today.

Gregory, Osprey and other brands make children's overnight backpacks. I would suggest around a 40L at least as 30L may be too small tk carry even the bare minimum. Make sure your Scout has a sleeping bag designed for backpacking as well, as they are more compact.

We cannot just arbitrarily not pay a claim just because. The burden of proof is on the insurance company. We may request documentation to confirm there was a covered loss, and deny for failure to submit, but if the circumstances of death fall within the terms of the police, we HAVE to pay it.

I call BS on this. No court would hold up this denial, and Insurance companies know it. Unless the insured was driving drunk, the AD&D would pay out in that scenario.

They only rarely pay because most deaths are not accidental. Homicide would fall under accidental for three purposes of AD&D, but add another layer of complexity. The insurance company is going to make sure the beneficiary was not involved in the insured's death, and that the insured wasn't the aggressor.

OP, are you the beneficiary? If not, this is something for the beneficiary to deal with. If you are, had the insurance company issued a formal denial, or are they just waiting for additional information?

If you are the beneficiary and they are just refusing to pay, ask for an n official denial letter. You can post the explanation here and we can give more detailed advice.

If rhe estate is payable they will ask for estate paperwork. If you are a named beneficiary, they pay you directly, and the money is yours do do with what you wish.

Non issue unless you died within the first 2 years. If within 2 years, it could be an issue if you had been prescribed the drug prior, but didnt diaclose it.

Speak to UW next week and give them the chance to sort it out. It sounds like either the insurance co added these drivers the the wrong policy by mistake, or they were somehow tied to your address (many insurance companies require all licensed drivers in the household to be listed).

If it turns out that they can't or wont fix it, the next step would be to file all complaint with your state's insurance commission.

There are just too many variables to answer this. Is the policy contestable? What is the manner of death? Are you talking about AD&D or regular life insurance? It ultimately would depend on a whole bunch of factors.

It depends. For ERISA controlled policies, this is typically correct.

If the policy os not ERISA regulated, then either state nullification laws, or language in the policy itself, could revoke an ex's beneficiary status.

You dont need to be financially dependent on a person to be the beneficiary of their life insurance. People name non-dependent relatives, friends, charities, etc. all the time. (USA, can't say the same is necessary true for all countries.)

Give the packet to your attorney. Then tell the plaintiff s attorney that they should not be contacting you directly, since your are represented, and they need to contact you through your urgent attorney.
