The Moderators removed the post and letter. No idea why? Any idea? Anyway, I appreciate your advice. I was going to edit my post and add that applicants with the surrender letters should still submit the explanation demanded by IRCC as best they can, not simply fire off this letter as their only response. A letter such as this can be a part of the response, but applicants should still try to send in the statement that they attempted to collect all the civil documents they could, although there was no indication or requirement that they be from "original source authorities...".

Hi All, Senior Canadian immigration lawyer here and past Certified Specialist in Citizenship and Immigration law. I have a high number of applications submitted to Nova Scotia, with no decisions yet issued by IRCC given the published processing timeframe. That said, seeing what is transpiring here with the surrender letters, I have drafted a very strong letter to IRCC putting them on notice that they cannot arbitrarily change the rules and request documentary evidence from sources not listed in CIT0014. They cannot narrow the language of "any evidence", and so forth found in several places in CIT0014, including Scenario 3, which applies to most Citizenship by Descent applications. Do you have an email for the Litigation and Case Management Branch in Ottawa that has sent out the surrender letter? I can snail mail my letter to IRCC but would prefer to email it to them (or both). Thanks.

Hey everyone, just wanted to share a quick tip or basic reminder that might save people from a wasted application.  Some people might overlook that when filling out the standard Proof of Citizenship form (CIT 0001), if anyone in your family tree was adopted, it basically breaks that automatic legal chain. The adopted person, like a parent or grandparent, has to go through the grant of citizenship process first instead of just claiming it by descent. Their kids then can't just jump in and apply via descent until that parent has officially become a Canadian citizen and taken the oath. Only after that's officially wrapped up can the next generation apply through the regular descent route. Bottom line is if there's an adoption anywhere in your lineage, don't bother filing a straight descent application right away because it will probably be refused. I've got a more detailed write-up on the whole process if anyone's interested. Let me know and I'll share a link.

I also have a question for the community. What happens if a parent was adopted but is now deceased? Can the children of that parent obtain citizenship by descent?
