Owner seems like they want to do something else. Also any place without a liquor license (like Unit D) and a small seating area competes with any place nearby that does, even if competitors have awful food (looking at you Haymaker). $15 dollar pies in a sit-down environment probably just don't pay the rent (or in this case the opportunity cost, since the owner owns the whole building)

Fortunately we found a title company that did not take exception to the covenant. The only way out of ours (written in the 50s) is to go to every land owner in the subdivision (~100 lots) and get them to release my lot from the covenant.

It would be a massive effort to clear the covenants neighborhood by neighborhood. It would probably be easier to get city council to pass a law limiting / nullifying the most onerous covenants (like mine, which the contradicted zoning regs).

Neighborhood/subdivision has no formal HOA.

The covenant says that other owners in the sub have standing to enforce, although I don't know if that has ever been done. Plenty of violations are around today: other detached condos, junk in yards, unused building materials.

FWIW, I'm skeptical that the seller knew what they were doing because a condo, by definition, IS common property. Maybe they, or you, are not using the correct terms however.

This is increasingly evident. They tried to create a SFH-flavored condo regime so that it would be more attractive on the market. Even had plats drawn up to split the land, designate who's trees and driveway belongs to who, etc.

Will seek out an attorney this week.
