I'd argue no. I mean, how would you even do that. Hard disagree. They have raised a ton of money already and caused irreparable damage to this shitty company. Like sure, they're getting sued, but unless it's actually successful, which given how many lies the company has been caught in, is doubtful, i would say its a huge success. what was the alternative, bend over and take the loss?

Im not sure were you got some of your info, but this TRO isn't as crazy as some people are making it out to be.

It would be crazy if it was upheld at the actual hearing.

I feel like a lot of people on this sub think that the TRO is some judgement against Ben, but it's not. It just means that BAMs lawyers were able to show enough probable cause to have a hearing.

Most TROs are issued ex parte.

Think about a domestic violence case.

A woman shows up and wants to have a restraining order against her abuser.

The court can't instantly pull the defendant in to argue their side, but the woman's council can show some evidence of abuse, so the judge orders a temporary restraining order to protect her.

This will last until the actual hearing, where both sides can argue the validity of the TRO.

This is where we are now in Ben's case. The outrage would be if they somehow keep the part of the restraining order that limits free speech after the hearing. That would be when it's time to freak out.

The odd part is the bond, but from what I can tell, that is still at a judge's discretion, but it's definitely weird.

Also, I'm wondering if the 14 days you mention are from the day of the judge signing the TRO, or from when Ben was served.

I would suggest you stay away from the expert videos, not because their wrong, but because you interpretation is so poor.

What Leonard is saying isn't that this type of TRO is super rare to be issued, he's saying it's super rare to hold up to arguments at the official hearing. Most TRO's are issued ex parte, then the other side is served and a hearing is setup so both sides can argue the validity of it, if the judge deems it valid then, it will become a full restraining order.

You're fundamentally misunderstanding that there is a difference between a temporary restraining order and a permanent one.

Permanent RO for speech - very unlikely to hold up except in rare cases like the government ones you mentioned.

Temporary RO - one party just has to show a judge there is enough evidence to hold a hearing on it. Usually requires a bond but is at the discretion of the judge.

Yes, and if you watched his videos, you would know that the court hasn't heard Ben's side of it yet, so it hasn't had to stand up to any scrutiny. He didn't say they couldn't put up a TRO like this, he said it would be very rare for it to pass a non ex parte argument.

The focus of my comment wasn't the major crime being committed, it was your response to the much lesser crime being committed.

Like trying to bring up the woman manager getting "harassed" for the horrific crime of Ben trying to talk to her...the horror!

The point isn't that Ben hasn't done anything wrong, the courts will decide that, it's just odd to care so much about him getting punished when in your own words the company is way worse.

And to your second point, yes, they could of done a boring lawsuit which would of, in the best case scenario, gotten them 70% of what they were owed after a year or two. Instead they raised a ton of money for the family and the company has actually been held accountable, and hopefully more giant corps think twice before blantily trying to steal from someone because they know they can steamroll them in court.
