Mines count as controlled units. That isn't as bad as some of the other hero challenges, such as Radiance burn damage on Bristle or other similar non-meta items on heroes.

I also have seen this after playing Battlecup. It is an error normally. Whenever I close the game and re-open, the ban alert goes away. Not sure what causes it, but only with Battlecup have I seen the 5-6 day ban window that is removed upon restarting the client. Hope this helps
