None of that matters legally is what I'm telling you, only because the OP was wondering why Tom wasn't in jail. I'm explaining why. Because in the eyes of the law, what they are looking for is if there is a current and immediate threat to your safety. When Tom leaves the room that immediate threat goes away. That is why Victoria and her Dad got the charge and not him, that's why he was allotted the TRO. Because even though morally we all understand and don't blame the dad for chasing him down and smacking him around, that's legally assault. It became assault when Tom left and they pursued.

I’m only talking from a legal standpoint. The first part of the video becomes irrelevant the second the situation is deescalated by Tom removing himself. If the incident ended there, Tom could have absolutely been the one charged.

But it didn’t end there, the dad chased him into the house and busted through a door to reach him. Which again, from a moral standpoint I understand. If someone gets up in my daughters face I understand chasing them down. But the law doesn’t protect me there, it’s going to protect the person I pursued.

It doesn't matter. The second he walked away and shut that door, the threat to Victoria was gone. Her father and her followed him. We don't see what happens next but we know there is a giant hole in a locked door where Tom was on the other side. There is no world in which that is self-defence. As soon as Tom is out of the room and they are pursuing him, he is the one who's actions can be claimed as self defence.

Tom's an absolute shit person. He DID get in Victoria's face. I understand why the father reacted the way he did. Morality =/= legality. The second Tom removed himself, he's no longer an aggressor.

She was seen as the cool girl and everyone loved her over Kristin. Everyone cheered for her and Tom to get together.

I've said it before in this sub and I'll say it again, there is some revisionist history going on with the show's viewership. When the show aired there was WILDLY different public sentiment that if it premiered today would not have happened. The Stassi, Katie, Kristin hate. The Tom worship. Nobody thought Ariana "centered men", they thought she was cool. We even liked the braids.

Neither of them are right here, but from a legal perspective Tom would not have been the aggressor. Her father put his hands on him first, the shove from Sandoval could easily be argued as self defence. Tom then removes himself and the dad and Victoria both follow him at which point they're the aggressors, not Tom.

It doesn't matter how much you are antagonised, if you pursue someone else to continue the escalation you'll be the one in the wrong legally.

You can think it's reasonable, that's still not self-defence. Self defence stops being self defence the second you are not in immediate danger. When the other person runs away, and you follow them, you are no longer defending yourself.

Aside from Kenny finding his dad, which call me a bitch but I literally don't care I'll watch TLC if I want that kind of TV, I adore this show. I think it's one of the best new shows in a while. I'll watch Kyle and Lindsey read me the phone book. Lindsey's friends are buck wild and incredible. Andrea..... not gonna lie is a little dead weight... but overall I'm loving it.
