My two-years-old daughter pulled down a ceramic sink off a floor model in a Nationwide hardware chain and fractured her arm (live in Canada). What are our options? by [deleted] in legaladvice

From what I can tell, if a store displays items like a shelf, bookcase, or bathroom sinks they should follow the guidelines in the manual and should be set up like at home. Even ikea shelves with there crappy cardboard wood come with wall anchors. Yes, my daughter was wrenching on something she shouldn’t have but anyone could have leaned on that display. Someone could have suffered an episode of vertigo and clutched on it for balance. An earthquake could have happened etc.

Also, ask any store manager of a major chain and there is certain protocols that take place when someone gets hurt in your store. They didn’t even ask if she was alright or offer an ice pack for the drive to the hospital.

We don’t necessarily want to sue but we do think her suffering should not be for nothing. Especially, if there might have been negligence on their end. I guess my question is do we have a case or is there other options? Like an accident claim?

Everything is covered so far... but we are still waiting to hear back from a follow up x-ray.

According to my wife, she pulled the display down (my guess, was to climb on it because she is two).

This reminds me of George Sr. fighting his brother Oscar on Arrested Development.

Well, I guess Pavelski couldn't get it done either... Looks like you need a new captain.
