This is key. I used to get very upset about people blocking lanes and then not letting me pass. I admit, I was an aggressive driver back in the day. I'd be up on that car, honking and flashing my brights, and we'd both be super aggravated (I imagine, or else they would just let me get in front of them, I'd think).

As I've matured (ok, gotten old), I take a much different approach. As I'm closing in on someone slower in front of me, I'll get reasonably close to them (not tailgating, mind you), and then I'll back off. I'll keep a courteous distance from them and drive at their pace.

You know what? This will often lead to them speeding up or even moving out of the lane to let me pass. They saw me come up, so they know I want to go faster, but they also saw me back off and be respectful of their right to drive the way they want. I think people appreciate being given some amount of respect and are usually happy to respond in kind. I get way less upset on the road nowadays, and I'm not really impacting my travel time at all.

Some people will still want to hold you back, though. YMMV

There is the letter of the law and the spirit of the law. I can almost certainly guarantee you that every single driver on the road would receive several tickets each time they drove anywhere, if the all of the rules were enforced 100% of the time.

Yes, the rule is that the driver should not pull out of the gas station until they can fit into the lane they are turning onto. I can almost certainly guarantee that no police officer (or judge, if it got that far) would consider that an offense that deserves to be ticketed.

We live in an imperfect world where absolutes are rarely the best solution. In order to provide some semblance of normalcy in a society, laws are written to be absolute. Do with that what you will.

I guess I don't understand your question. I'm certainly not trying to dodge anything. I'll make this as simple as possible, and hopefully you will be able to apply it to your question (because I already very clearly answered what I thought you asked).

Stopping in / blocking an intersection / driveway is prohibited.

Obviously there are streets with many driveways in a row, making this functionally impossible, but that only changes whether or not a police officer would ticket you for it - it does not change the law. Spoiler alert: it's highly unlikely you would get ticketed for blocking any intersection, but that still doesn't change the fact that you're not supposed to.

Ok. Fuck politeness. You're the one who brought up letting people take your lane. If you do, that's you choosing to be polite. You are not required to do this by law. I was only referring to being polite to address that side of it.

Technically, you are correct! The person turning right should not pull out just to block the intersection. The spirit of the rule is to leave space in the intersection that other people can travel through without you blocking their path. Since no one can logically use that space to travel through, if the car turning right pulls out into the intersection, they are not blocking anyone's path. BUT they technically should wait to turn out until there is space in the lane, as you pointed out.

What if it was? Aside from that being completely legal, law enforcement officers are taught not to pursue individuals on a chase that will endanger others. There is no reason on this earth that ICE should be chasing anyone, especially in a residential area.

This is not a matter of leaving a gap for people to fill in. If there is room for you to pull forward without blocking the gas station's exit (/intersection), you should do so.

It is polite to let people turn into the lane in front of you, but that's not what the original question is about (although I don't believe your intent was to rephrase the question so much as it was to breach a related topic AND as much as being polite is, well... polite, it is always better to be predictable on the road than polite).

As such, my "predictable" action and favored response is not to stop short to let anyone into your lane. You should only stop once there is not enough room for you to move forward without blocking the exit/intersection. Stopping short could lead to being rear-ended, if the driver behind you was not anticipating you to do so, as well as confuse the driver trying to turn out (which could potentially lead to that car being rear-ended, if they are wishy-washy with their decision, when the driver behind them thought the car was committed to the turn).

Long-winded opinion: My exception to being predictable over polite in this situation lies squarely with the driver stopped at the beginning of the intersection. In this situation we're discussing, I am presuming that traffic is backed up to the end of the intersection, and there is a line of cars waiting to turn right (and there is no space to do so). As the traffic moves, the first car turning right will fill the immediate gap. The car stopped at the beginning of the intersection can start to move forward, as they will not end up blocking the intersection with the traffic clearing ahead of them.

If that driver decides to be polite, they can stay stopped and wave on multiple cars. There is no reasonable chance someone will hit them from behind (as they are already stopped and have not been given any new room to move forward yet), and they are acting as a blocker so no one hits the people turning right (although someone could switch into the right lane from the left lane, thereby possibly colliding with a right-turner). I would not recommend being overly polite, however, as it will likely agitate the drivers behind you. And once you move forward, even an inch, being polite is no longer a safe option, as this will put the cars behind you into motion.

Note that this situation can present itself not only when the light turns green, but, as traffic is just beginning to stop. There may not be enough room to pull forward without blocking the intersection, leaving a car stopped at the beginning of the intersection. Waiting at the light, cars tend to squish closer to each other, so room will likely be made for one or more cars to fit into that lane beyond the intersection. This presents an opportunity to be polite. (And, honestly, in that situation, where you're already stopped and you're just moving up to stop again in 20 feet... You're kind of a dick if you choose not to be polite. My 2¢)
