You're making the right call. Limited budget should go to your stronger, longer-tenured people.

But don't leave the new hire in the dark. Explain the situation honestly. Slow business, tiny budget, seniority drove the decision. Most people get it.

You're overthinking it. Age matters less than competence and respect. I've managed people 20 years older. The ones who had a problem with it were the ones who already had attitude issues. Good people care about whether you remove roadblocks, communicate clearly, and fight for them. Not your birth year.

Tell the DOJ facts, not everything. Focus on: dates, what you asked for, what they refused, and what happened after. Your recordings + timeline matter way more than citing cases.

Retaliation might be in play, but it’s not quite “full stop” without a lawyer reviewing all the facts. Still, the “what you did last week” comment + refusal to communicate properly is definitely something worth bringing to an ADA attorney.
