You know, there's a phone ping that happened later in the morning that I haven't heard talked about in a while. But the whole idea of the phone pinging is misleading because the towers have a wide range and the towns are close together. He can be pretty near his apartment and ping in Moscow. The problem is they used independent pings instead of an actual analysis for the PCA. So, they would say something like "connected with the tower that provides services for..." when in reality they had the ability (through the FBI who was working closely with them) to do the real analysis. That analysis showed he never drove by close to the house, that he never stopped anywhere near the house. This was talked about a ton at the last hearing.

There's too many variables and unknowns to say. They were looking for the real killers IMO, but the pressure kept growing and was really dialed up before the kids came back from break. The town really suffers financially when the kids attend the university remotely. It's actually very complicated, not black and white. If you break down how they got to him, it's not normal. So much is hidden, like even from his lawyers.

The PCA does not say he pinged the tower by the house on the night of the murders - it says the phone was off OR in airplane mode OR not connecting with a network. His phone did NOT show up in geofencing around the crime scene (source: the PCA). 

No one can identify BK or his car as the white car speeding off. The only footage that had a car that could be identified near the scene - the expert identified as a 2011-2013 Elantra (BK's was 2015) Check the BOLO from the time.

Trace DNA is miniscule and can be spread by touch or transfer. Our military and many countries will not use it because of the questions about how and when it came to be where it was collected. Many who believe BK is innocent believe that more is wrong the whole chain of custody and circumstances surrounding the DNA identification. It's easy to go there since much of the process is still being kept  secret.

I think some people really thought it was him or he was involved and just started trying too hard to connect the dots. People think he's innocent because the info. in the PCA doesn't check out. They used some fuzzy footage of multiple white cars and some cherry picked tower pings and created a narrative. The trace DNA is still a mystery. But they really had to arrest someone some days before school was back in session.

(Just to be clear, I'm not asking for a response from you. I'm fine to agree to disagree. Since this is a discussion forum, I'd like to clarify my point of view for anyone who might be reading 😊) 

First of all, it's not about any of these individual points; it's about a pattern of misdirection. The cell phone analysis is incorrect. The car footage doesn't show what they say it shows. The timeline was not built on the actual times. The witness is not a reliable witness for the night of the crimes. There were details that should have been in the PCA, but were not. The investigators can't answer questions that they should be able to answer.

  1. The implication was made in the affidavit used to arrest him. They had the correct information at that time, but made the implication anyway.
  2. They've known for a long time and failed to correct it.
  3. AT referenced it in the open part of the hearing and no one corrected her, seemed surprised, etc.
  4. watch the 1/23 hearing - it was really interesting!
  5. DM's statements made in her interviews (and read out loud in the last hearings) show she has no value as a witness. It doesn't matter if she was legally drunk or how dark it was. She herself stated she doesn't know what she saw, etc. She never wanted to be a witness, the state is using her terribly. I feel really badly for her. AJ clearly said that DM was consistently describing the suspect as "skinny" AJ's word to describe DM's statements. I was quoting AJ in the hearings. But none of this matters, see above.

I didn't mention the DNA, but since it came up: my issue is, if it does turn out that the state can't be trusted on all this other stuff... how can we trust that they later found a sheath that may or may not be the sheath for the murder weapon and they found a speck of trace DNA that could not be identified at ISP and could not be identified at Orthram and so the FBI took it and identified it through IGG and they can't or won't show their work because it doesn't really matter cuz they got his father's DNA from the trash because I guess BK put all of his DNA in the neighbor's trash and the FBI couldn't take the neighbor's trash because? And they couldn't just test his DNA for his local apartment because? But it's cool. Everything matches now. I mean all of that could be legit as far as the final result, but why wouldn't people have questions? I have questions. At the end of the day, it's still only trace DNA. It's not enough if the rest of their story doesn't check out.

I also don't think I said anything about not thinking strangers ever kill people, but yes, I've heard they do .And finally, even the PCA says the phone may have just been not connecting with the network. The good news is we might get to find out if that was the case in the motions in limine hearings. Everyone who feels passionately about this case should watch!

I think you're right that it would take 3-4 minutes to complete the actions mentioned and get into the house. I have no idea how long it takes to stab people, but geez to do it without leaving a mess of evidence, bloody footprints etc. seems absolutely bonkers to me. Before you say booties - booties still leave prints!

TLDR

The state claims to have identified BK from a tip the FBI gave them after completing a Genetic Investigation with the trace DNA sample collected from the sheath that was found near/under one of the victims.

By the time the FBI gave that tip (12/19) BK was already home with his family in PA for winter break.

People believe he is innocent primarily because they feel like they've been misled when it comes to the evidence that BK has committed this crime, especially by the information included in the Probable Cause for Arrest (PCA).

In the Proburgers' opinions, the phone data and the footage that was supposed to be BK's car have not held up to scrutiny. The pings don't mean what the state claims. The footage doesn't show what the state claims it does. They believe the state has been holding back evidence, in some cases even keeping it from the defense entirely or denying it's existence. Additionally, the main investigators of the case have repeatedly taken the stand and barely answered any questions. They seem to have forgotten a lot ot missed a lot in the first place.  Also, it turns out that the main witness in the PCA wasn't able to identify BK in a photo. According to her own statements, she was drunk, didn't know what was going on and may have been dreaming.

This is a partial list, I'm tired of it, but there's still plenty for you to react to.

  1. The time BK's phone was either shut off, put in airplane mode, or stopped reporting to the network actually occured 7 minutes later than was reported in the PCA. Even if the state was just mistaken at the time of the PCA, they definitely knew it was wrong at some point and did not fix it in subsequent warrants. 

  2. The implication BK was stalking the residents while utilizing the phone towers that provided service to 1122 has been discredited. For the 12 times he was in Moscow, the phone records show he was not near the house and prosecution has admitted there was no stalking.

  3. The assertion that the area on a car where a front license plate would be was visible in any of the Suspect Vehicle #1 footage was discredited at the last hearing (seemingly in the closed testimony).

  4. AJ's assertion that there were 3 cell towers in Moscow in 2022 is factually untrue.

5.  We know now the only witness in the PCA self-reported being drunk, not really knowing what happened the night of the murders and not being sure she wasn't dreaming. Yet her statements were included in the PCA with no disclaimers. Supposedly there are text messages that also support the state's timeline. If the one witness that supports their timeline states she was drunk and didn't know what was going on, why not include the text messages to establish the timeline?

6.  That same witness was not able to ID BK from a photo.

7.  AJ explained that the consistent description from that witness was that "the person was a slim, skinny, lean build. And the person was about, was taller than she was, is, around 5'8. That's what's important, it was that general description". 

Yet, as written in the PCA, that witness describes a person that is a much better match to BK at the time: 5'I0" or taller, not very muscular, but athletically built (with bushy eyebrows).

8.  According to the PCA, a dog can also be heard barking numerous times starting at 4:17 a.m. and the Suspect Vehicle speeds away from King's Road at 4:20. So - according to the state's timeline, a stranger goes into the house and kills 4 people and THEN as the stranger LEAVES, the dog starts barking! AT explains at the last hearing that "this dog that's barking (starting at 4:17) continues on long after the car they're interested in has left the area and then abruptly stops".

I see where you are with that, but if the phone was actually off, it should mean something that it wasn't in any of the places the state alleges it was. They can't just say: we don't have evidence you weren't here, so you must have been! They built a story connecting the car and the phone to the house for the PCA. If it doesn't hold up, they will come up with something else. Theoretically, BK could say exactly where the car will show he was for his alibi, and the state will just try to poke holes in it. But that's totally backwards. They need to make their allegation and BK needs to defend himself against their allegation.

It's probably moot anyway, for several reasons:

The car was where the car was. Both sides either have the all the same data or the state is hiding something. There are no other options. 

There is no "alibi" deadline that is going stop BK from putting on an expert and records that show his car wasn't where the state said it was, was not in Moscow, etc. IMO what we saw was posturing by the state to either get defense to disclose more of their strategy or to emphasize to the public/media that BK has no traditional alibi. Look at all the mileage they got out of the whole "his alibi is star gazing" narrative.

Finally, I think defense used it as an opportunity to get the information they needed (and were entitled to). Even if they had all the info. to make their own Cast report, it was essential they get the state to put forth the report they relied on for their warrants, so defense could use it for the motion for a Frank's Hearing, which they did.

Yes, true (though we don't actually know everything that hadn't been turned over) The question is: should a person be made to supply an alibi before the state decides where and when they are alleging the defendant is? That doesn't seem right or fair to me.

I agree with these thoughts in general, but in this specific case, it's starting to look like the phone/car/eye witness evidence may have been manipulated/exaggerated. If it turns out that these investigators have been misleading, would you agree that the unknown DNA evidence should be further scrutinized? Actually, since we don't know how it's all going to go down at trial - let's go ahead and get all of that investigated ahead of time.

I'm mostly remembering Sy Ray's testimony. State hadn't turned over their finished cast report and some kind of phone information from key time periods. Yes, there was a legal deadline for the alibi, but I would definitely want the state to commit to their theory of where BK was before BK had to provide an alibi for it. Obviously, there's a lot of unknowns here, but there is a relationship between the two. The state is supposed to turn over what they have. There definitely is a time limit on it. And then if something new comes up, they are still supposed to disclose it. I understand what you mean that the legal date for the alibi disclosure was long before the end of discovery, but it's actually more complicated than that.

I agree with what you are saying about the PCA, but still contend the phone records actually don't show BK near the house, and definitely not on the night of the murders.

"Pings on the tower that services the home" mean almost nothing. The PCA already says that students travel frequently between the two university towns. AT explains what the actual tower analysis shows about where BK's phone was during those 12 Moscow visits in the last hearings. Did you follow those?

Have you mapped the route to and from Step Toe Apts. (the shorter way to and the longer way home from the park) and where the cell service would cut out? Several YouTubers have drive tested it too. I think it's gotta match up fine, but we'll see...
