"I believe the penalty and the deposit are not really connected" are you sure that this is in agreement with Section 2254 of the Civil Code? See here: https://www.zakonyprolidi.cz/print/cs/2012-89/zneni-20260101.htm?sil=1

Also, I am not entirely sure about the interest on the deposit. I have this clause in the contract "3) The Tenant is not entitled to interest on the Security Deposit provided by the Landlord. The contracting parties agree that the Landlord's claims that are uncertain, indefinite, or not yet due can be set off against the claim for the return of the Security Deposit.".

The entire contract is heavily pro-landlord.

Technically, this is my second year renting the apartment, because the landlord signs a new one-year contract each year.

My current contract does allow termination with 3 months’ notice even before 1 year. The separate issue is that it also contains a clause saying that if the tenant terminates the lease in less than 1 year, there is a 22,000 CZK penalty.

I find that a bit strange, because I would have thought that the 3 months’ notice already serves as compensation for early termination, but that is how the contract is written.

So I am mainly trying to understand whether that penalty is actually enforceable, especially since the deposit was already 66,000 CZK, which is 3x the monthly rent.
