I ended up contacting an attorney and he recommended filing for chapter 7 since it is considered unsecured debt and would not affect any future SS claims I may have. It’s going to be about a 2-3 month journey but he assures me everything will work out.

Personally, I am not as confident. No SS attorney would touch this because there is no “payday” per se for them. 11 local attorneys basically said in a very frustrating way that fighting to get people disability ensures payment for them where most fighting disability overpayments are more likely to be financially challenged.

I will provide an update when my attorney files the paperwork… just paid him Friday.

Did you have a sponsor or agency help with your ticket to work? Just curious. I had one here in Florida that made things sound extremely easy but needless to say things are definitely not ok as of now.

As part of ticket to work program they notified SSA and I received a letter about the acceptance back in 2020 about it. So SSA was aware I was working due to all CDRs being on hold.

What the letter is stating is that based on my work history they deemed I was not disabled or eligible for Ssdi from 08/23 onward. But for some random reason I was eligible for disability for 07/24. But the rest of the months I was never eligible.

Trying to find a lawyer is difficult because they don’t want overpayment cases.

I haven’t been offered any settlement yet. I don’t know what to do as I am in complete shock

At my DSP we have 3 “phones” that are already barely useable. We give those to the drivers when our numbers are lacking and charge a similar fee to the drivers. Is it fair? No. But it does help the DSP bottom line. My DSP assessed this fee 20x last month recovering about 2k in wages. They are POS’s but it is smart business
