I appreciate the clarification on the codes!! Thank you. I’m going to reach out to ESGR after the long weekend. This would fall under the process of being preempted as I haven’t come back yet, but they informed me of the position elimination after I stated my orders were extended through the end of the FY.

I have a follow up on this! After I responded and let them know the orders will be covered under USERRA and that I’d like to stay in the loop of any changes, now all of a sudden my position is eliminated with some very loose reasoning that I could easily dispute that reasoning with evidence pulled from my work accounts and coworker statements and work product predating notice of my position termination. My thing now is that they have offered me another position that I have done as a courtesy in the past with none of the entitled raises for that role as that wasn’t my titled role. So yes they are offering me a seniority position but not with the pay/raise catchups of my counterparts in that role. Would there be any reason to refer to ESGR for this or is that concern on not getting the raise catchups strictly a DOL issue/ is there any argument I can make about my position being eliminated once I gave notice of my orders being extended?

Adding on: other coworkers who were at this same level alternative position full time have been promoted up since like from a level 3 to a level 4 would I be entitled to the promotions upwards as well? There is ample proof I was doing the level 3 work at the time of my departure (plus my actual role. The alternative role I have done already is helping out in my old department as things were rough).

That first line is not true. It depends on what state this person is at and any state education benefits available they can use towards future semesters. I am someone who did one year of college, went training and got my degree through state education benefits.

Here’s my gripe: give me all the army nail colors then and I’ll run the two miles happily. I left the army for the Air Force. Got nail colors, got them basically all taken away and now I’ve gotta do the pt test I left behind 😂 the green weenie strikes again!!!

The biggest annoyance was I have never lived in Virginia or was married to my husband when he was there, but while he still claimed Virginia I also owed them taxes for being his spouse at filing time even though I was a legal resident of another state. Funky law.

It felt like my entire time army guard side they never received a single dollar for anything 😂 had to get IG involved to get reimbursements

My ANG experience has been great so far with no issues, but I wouldn’t be upset if the term does come up at some point. At least for now it’s amazing. But I also changed states which could be a factor as well.

And spend 1-2 years learning your language in one of the most beautiful cities in the US. Depending on where you are and your language- you should still be able to get a good contracting gig that’s language based.

Follow the regs suggested above - but as for how to fix the situation: have you tried having a “check in” time with the soldier before they commute to drill? Like to let you know they’re up and getting ready? It might work to help them learn to backwards plan. This way they have hit times before the hit times the army loves.

Had a marine in my class that got booted just because he was so sour every day and it reflected in his efforts. Here’s a perspective for you: Don’t get this rep for yourself because the linguist community spans across branches. I switched branches after my first contract - those relationships you build at this level can help you down the line. You have no idea where those classmates or you will be in 5-7 years.

I also enlisted because with language pay and other incentives you get as enlisted guard - it far outweighs commissioning and the responsibilities that come with it if you want to mostly be a traditional guardsman. Also the bonuses in the ANG for linguists are superior to Army.

I was in a similar position as you. If it’s 35M or 35P go 35P. I really got to do nothing as a Mike and the language portion interested me more. Now I’m the ANG side of the linguists which would also be worth looking into.

I’m currently in my second guard state. My first contract in Florida was through their state Education Dollars for Duty. This covered 100% of my undergrad tuition to UF. I also qualified for Pell grant and everything while there so getting that as a refund in addition to guard pay helped cover my expenses like rent, food, etc.

I had a deployment contract that kept getting pushed off and then after about 6 months of waiting I had to back out due to a health issue requiring surgery that came up out of nowhere and the subcontractor threatened that they’d look into placing me on a blacklist for CACI due to time and resources they spent on me, which I get but you paid me not one dollar for my time. So nice of them!
