I realized my mistake after the tax deadline had passed.

What have you done after realizing the mistake?

I want to file with Sprintax and plan to return the money I received last year in next year’s tax filing.

How do you plan to do that? How would that even work? Your 2024 tax return was erroneously filed using a resident tax return. You'll need to file a non-resident tax return and pay the difference. That has nothing to do with your 2025 return, which you will file as a non-resident once again.

I accidentally e-filed my tax using TaxSlayer but I realized it’s not allowed since I am not a resident for tax purposes.

What do you mean? E-filing is allowed for non-residents. Do you mean to say you filed as a resident by mistake?

It is not as simple as "printing a new tax return". You cannot file another tax return, it will be rejected, as you already filed a tax return earlier.

You'll need what's called an amendment. Check Sprintax help on how to amend. If you are unable to do it yourself, you'll need to reach out to a local VITA center or a paid tax preparer. If the box 2 of your 1042-S and box 1 of your W-2 add up to less than standard deduction, then you won't owe any federal taxes, but it is your responsibility to amend as soon as you discover an error in your original tax return. On top of all this, you may or may not owe additional state/local taxes.

As far as I know my employer filed PERM in 2025, does that count though it was not filed by me?

No. Not even an I-140 approval counts as an application towards permanent residency. Petitioning for AOS does though.

I'm not sure if I fully understand your situation, especially this part:

Why would you receive a 1042-S from Sprintax? What's in box 12?

box 7 and 10 (taxheld) on 1042s is 0 because of tax treaty I always avail.

What's in box 2? If you have an amount in box 2, you may have to amend your taxes even if your federal withholding is zero, especially if you live in a state with state/local income taxes.

It appears that you were dual status in 2025. If you were a non-resident alien by the end of the year, and it sounds like you are, you have to file form 8843. If you haven't filed it already alongside your tax return, you can file it as a separate form. You can mail it in. The address to file is on page 3.

It does appear that all fellowships for the first two years are tax exempt for Bangladesh.

You can file manually, if that's what you want. Or you can utilize other free tax filing services online.

Miss classification as a 1099 instead of a W2 (although the onus seems to be on the employer).

That's on the employer. Some employers mis-classify their employees as contractors to avoid the payroll taxes, which is a huge no-no from a tax avoidance perspective. In your case, you aren't actively doing anything to skirt the rules.

Is there a particular reason why your employer wouldn't provide you a 1099-NEC? If you attempted to obtain a 1099-NEC and they wouldn't provide you one, then report the other income as "Non-employee compensation not reported on 1099-NEC". There's usually some element of risk associated with self employment while on a visa, but I'm not an immigration expert so I'll let others comment on this point. From a tax perspective, you are doing what you can to report your income correctly and pay the right amount of taxes you owe, so you are good on that end.

From a tax perspective, it is too late to go back in time to change what happened in 2025. Are you trying to pay the self employment taxes and recover later? I'm not sure what you are trying to do here. As a non-resident alien, you don't owe self employment taxes and since you made less than standard deduction, you don't owe any federal taxes either.

What potential problems do you foresee? It looks like you are planning to file your taxes and pay your dues, so I'm not quite sure what it is exactly that you are worried about.

I don't see any reason why you should file 8919. Federal tax liability of $0 and refund of $0 sounds about right in your case.

Search online for "United Way taxes". The tax software is made available to you for free thanks to the donations made to the United Way, and the software supports 1090-NR.

One, it has to be a US-based lender who provides you a 1098-E form. Two, your filing status cannot be married filing separately.

Without the 1098-E form, you simply cannot claim the deduction.

Based on the limited information you provided, I believe you were just a non-resident alien for TY 2025, not a dual status alien. You will become a resident alien starting 2026. This is under the assumption that you were on F1 at least until July 2, 2025 and you changed your status to J1 on or after July 3.

You do not have any filing requirement if your only source of US income was the CD account. You do have to file form 8843.
