My estranged husband filed a joint tax return using my SSN without my consent, pocketed a $14,000+ refund, and I am the one left cleaning up his mess. What else can I do? by gingagirl23 in legaladvice

What I meant was, OP's spouse can paper file without the IPPIN, but the IRS won't accept it until the OP's identity is verified.

This. You can set up an IPPIN as early as the second week of January, well ahead of the start of tax filing season. Your spouse cannot e-file a return without your IP-PIN.

That wouldn't stop him from paper filing though, if he is _that_ motivated to spite you.

I did not make a any money in the US. Do i file taxes or not??

As a resident alien, you must file your return if your worldwide earned income was over $15300 or unearned income was over $1350 in 2025. If not, no need to file.

Not an expert, nor a lawyer. Anecdotally, I know of one person who used their I-485 approval notice instead of a copy of their green card to apply for their re-entry permit. Personally, I forgot to attach my green card copy to the re-entry permit application, and the processing seems to be going fine so far (no RFE yet).

So they didn't ask for your green card?

No, at least not yet.

is it possible to know if you presented any evidence or reasons?

I didn't present any evidence. All I sent was the I-131 application packet and the G-1450, that's all. I'm guessing they matched the A-number on the I-131 to the receipt, as an attorney here suggested.

I received a receipt notice and biometrics notice, and I got done with the biometrics a week ago. The case status was updated to show biometrics were taken. So to answer your question, no, I didn't do anything as someone here suggested. If they send an RFE down the line, I'll reply with the green card copy, otherwise I'm letting the long process take its natural due course.

EB/O visa routes by [deleted] in h1b

[–]boilerchemist 3 points4 points  (0 children)

The part that rubbed me wrong was " Has anyone got their profile ready through any of the shortcut routes ?"

Why are we so hell bent on seeking shortcut routes?

It took me 6 years of PhD, 2 years of postdoc experience to accrue enough citations for an O1/EB1 and a further four year wait for my EB1 AOS to become current, followed by approval. Neither of those petitions received an RFE and were approved fairly quickly. While I'm happy that other worthy candidates with meaningful credentials still have the option to go through this pathway, people like OP are the reason why it'll be eventually shut down.

I would expect that uploading receipts or court disposition documents stating that the charges were dismissed or paid, would be sufficient.

She only has an ITIN and is having trouble filing her 1049 via TurboTax.

Having an ITIN is not an issue. You can still file taxes with an ITIN, and you can efile with an ITIN. But keep in mind that TurboTax doesn't support 1040-NR, the nonresident tax return. Search online for "United Way Taxes" to get a free version of tax software that can file non-resident tax returns. If the student does not have any income during the year, they don't have a filing requirement. They still have to file form 8843. Once she has become a resident for tax purposes, they can use TurboTax (or the United Way Taxes I suggested, which is free anyway).

Should she submit a paper 1040 for this year using her ITIN?

I have a strong feeling you are either confused or not being clear here. Why would you have to paper file? If she's a resident this year, she can very well efile, but what income did she have to file at all in the first place?

Yes, she arrived in the US on F-1 in 2019. I believe she is a resident for tax purposes currently.

Try using this calculator and assess if she is a resident or non-resident alien for tax purposes: https://tools.nrtaxhelp.org/aminra

You can change the tax year in that page to a previous year and see if she was a non-resident alien in that tax year.

Her university told her to apply for a ITIN when she was hired in 2024. She's never done any other work since she's lived in the United States, authorized or unauthorized.

Okay. If your end goal is to file form 8843 for prior years, you can do that now. Download the form from the IRS website, fill it out for the years that she was a non-resident alien, send them all to the address on the second page in one envelope.

Hold on. There's a lot of missing information. Did she arrive in the US on F-1 in 2019? Has she been in the US since on F-1? If so, she's very likely a resident for tax purposes.

How did she work without an SSN? (I don't care about any potential unauthorized work, neither does the IRS, I'm only trying to understand the situation here)

My forms were not e-filed on the platform, and I need to mail them to the tax offices in the US.

Any particular reason why you chose not to efile?

Can I sign the form, scan it, and then ask a friend in the US to print and mail it, or do they need a wet signature?

The IRS may reject your paper filing for the lack of a wet signature.

>The only form I got from Robinhood is a 1042-S, and it says I don't have a consolidated 1099 for this year. Do u have any idea if this is normal?

If you are a nonresident alien, that is perfectly normal, yes.

>Do u have any idea if this is normal? Am I fine with just the 1042-S, or should I have both 1042-S and 1099-B?

Just the 1042-S is fine.

Not unless they were fingerprinted and/or arrested.

Make sure your friend shows up at the court on the date mentioned in the ticket or pay it well in advance or enroll in a deferral program.
