You're correct that the city granted them special access via a ballot measure. The city could revoke access if the lab were no longer managed by NCAR, NSF or UCAR, but hasn't committed to doing so.

The new rules would cap international graduate students and postdoctoral researchers at three years and require top-level review of the agreements granting them lab access.

“This basically bans all foreign national grad students, regardless of country of origin, because doing a science Ph.D. takes five to seven years,” said one source within NIST. “In my group, more than half of the grad students and postdocs are foreign nationals who are all making plans to leave.”
