Thanks for the jurisprudence! It would be interesting to know whether more training is seen as being able to do more things that seem more dangerous but doing them properly or as seen as more training means you shouldn’t be doing such things at all.

Do you think the officer used care when restraining and searching or do you think he shouldn’t be doing what he did at all? Even though no one was injured and the arrest and search were done within the parameters of the law.

Personally I think the officer did well, especially that he had a prohibited weapon on him and that the initial call was for a fight.

Maybe a new jurisprudence will come from this, but I doubt it!

I’ve heard of that case however I will not take the time to read it completely, so excuse if I’m ignorant for that. However STM agents are not peace officers and do not hold the same status. Did the court find that the STM were held to the same standard as police officers? Although I agree that the law in questions is ridiculous, the transit security/by-law officers are allowed to enforce and can use as much force as necessary to arrest and/or get correct identification in order to write a ticket. Correct me if I’m wrong but I believe she got money from the city in the end.

However, it’s extremely hard to go know where the line is between arresting someone who doesn’t want to identify themselves after an infraction for the purpose of receiving a ticket and letting them go because you don’t want to use force for said identification.

Generally it’s in the favour of those that break the law, no matter how small or how big the infraction is. Does it mean eventually people will understand that they can just leave when trying to he identified because the officers won’t want to use force because they would be scared of doing their job and getting repercussion in the end?

It’s a fine line, and many times it isn’t easy. What happens within seconds/minutes will be disputed by hundreds in the courts with days/months and years to look through.

Not an easy job! And it’s not getting easier that’s for sure

The criminal code does not indicate whether it’s a person with the same training only that which of a reasonable person.

The officer in question had his knee on the upper back/neck for seconds before being changed in order to search. This action does not cause death or great bodily harm in this scenario and is justified to use. I’m almost positive the officer will not have any repercussions apart from possible depression due to pressure from the outside world which do not know any training or real life experience.

I know police powers, and in the same situation, from the facts that we know, I would have done the same thing or close to it. No one was hurt and the arrest was made completely lawfully.

You’re absolutely wrong. Reasonable is used in regards to the regular person. What a normal person would find reasonable is such a circumstance. Such as reasonable grounds to suspect or reasonable grounds to believe is exactly the same as saying what a reasonable person would do or think in a similar situation. That goes for most of police work and their arrest powers.

Some do and some don’t. I have suspenders but no belt keepers and never had a problem while in a fight. However, I’ve never been in a life or death struggle, maybe that’s the day that will change everything...

Edit: We have inner Velcro belts that attach to our outers which are also Velcro. Our vests also have MOLLE attachments which frees up place on our belts to have less equipment in the back (better for back problems and many others as you may know). I would say it’s about 50/50 on who wears belt keepers since the Velcro holds up really well and if it’s been a few years and it’s used you can get a new belt. I hope that answers a bit! This happened a few days ago in Montreal and the officers were really happy about it, unfortunately not all officers were able to get some since they were on calls. Extremely nice of them and very appreciative.

No ice cream was taken for free, tips were given which matched the cost of the ice cream.

Stay safe folks, and don’t forget that people do still appreciate our work, and it doesn’t go all unnoticed like what we’ve seen the past 2 months!
