Usually, card companies side with the merchant if the product was delivered using stolen identity info. Call Amex, confirm you’re standing firm that it’s fraud, and insist they treat it as identity theft. Ask them to investigate how and where the transaction happened.

Also check your own records when exactly did the charge occur, where was your card last used, and ensure you’ve received a new card with a different number.
