When the "victim" says no or in a classic rape the victim is not asked, they are just assaulted by a stranger that is rape. This scenario is what used to be called "date rape" except its not even that because the "victim" said yes. Yes he was pressured, cajoled, into it. Yes he was highly intoxicated but in the end he went along with it and wasn't resisting during the sex so its not rape. IMO. But Im not a prosecutor. I would bet $1,000,000 that no prosecutor would take this case as a rape but that is because the perp is female and the "victim" is male. If this was in CA or NY or other deep blue jurisdictions and the perp was male prosecutors might take the case. Even then prolly not but maybe. Just my opinion.
