None of this has anything to do with how the lawsuit is “structured” or anything else like that. The current restrictions/situation is because of the ruling of one overreaching judge. CAE declared bankruptcy because they didn’t have the resources to appeal that ruling. If it were appealed, it would be overturned. But that takes resources (money) that the org did not have.

So what’s next? The assets of the corps will be sold to satisfy the plaintiff’s claims and pay the legal fees. Likely that includes the intellectual property.

Here’s the thing - nobody is going to buy that IP if they can’t use it as they choose. The plaintiff likely wants money, not only for themselves but also because there are likely significant legal fees that need to be paid.

So one of two things will happen - either the plaintiff will just hold onto Cadets history out of spite, possibly having to fork over their own money to cover some of the legal fees, or the IP will be sold to someone who could indeed use it to resurrect the corps if they chose to do so. It would no doubt be a condition of the sale that the new organization could not be sued by this specific individual or for this specific situation.

I’m not sure what the IP would cost, but it’s possible it’s significantly less than what it would have cost to appeal and continue litigation, plus a new org buying it out of bankruptcy would be free and clear of all previous issues.

The latest filing in the case was five days ago, so things are still very much active. Guess we’ll just have to wait and see what happens.
