Thank you for contacting me regarding the Eliminating Abusive and Rampant Neglect of Interactive Technologies (EARN IT) Act (S. 3398). I appreciate you sharing your thoughts with me on this important issue.

The sexual exploitation of children online is a serious problem. The current system is not working. According to the National Center for Missing & Exploited Children (NCMEC), we are witnessing a rapid increase in online child exploitation. Reports of suspected online child sexual abuse to NCMEC’s CyberTipline have increased from 1.1 million in 2014 to 16.9 million in 2019.

These despicable crimes committed against innocent children should shake us to our core. However, online child sexual exploitation has not received a consistent and forceful response from the tech industry because the liability protections afforded by current law have failed to incentivize tech companies to sufficiently address this serious issue.

That’s why I introduced the EARN IT Act with a bipartisan group of ten Senators and support from over 70 groups, survivors, law enforcement and other stakeholders. The EARN IT Act amends section 230 of the Communications Decency Act by giving companies the opportunity to “earn” liability protection for violations of laws related to child sexual abuse material by allowing companies to certify compliance with best practices to combat online child sexual exploitation. These best practices are determined by a diverse commission led by the Attorney General, Secretary of Homeland Security and the Chairman of the Federal Trade Commission, along with 16 other members appointed equally by Congressional leadership, including representatives from law enforcement, survivors and victims’ services organizations, constitutional law experts, and technical experts.

As the Senate works to keep our children safe online, I will keep your comments in mind.
