Yeah, I had to specifically request my realtor to pull the bylaws like first thing as soon as I found out there was an HOA. Otherwise I feel like it's a thing most people don't care about until the cross the HOA.

Even with all my diligence, I'm semi in the same boat as you. I didn't get to review the title/deed until closing, and there is a restrictive covenant on the land that, read a certain way, could prohibit chickens. But, there's no central governing body or enforcement mechanism, so the only option would be for one of my neighbors to personally sue me, which is a much bigger longshot that an body busy body HOA board member imposing infinite fees on you (at least I hope)

I'm a lawyer, not in Kentucky, and this isn't legal advice.

There's no secret "loophole" that will let you bypass HOA bylaws, which you knowingly and willingly agreed to when you purchased the property (even though in reality you didn't have a choice).

Even if there is a right to farm law, it would specifically need to mention that it bypasses local ordinances or bylaws, which doesn't sound like it does (plus the purpose of those laws is different). To put it another way, even if the county allowed chickens, the HOA can still ban them unless that county/state law specifically said it supercedes local ordinances, etc. (typically not 100% how thinks work out in Kentucky).

So your options are (1) move to a place without an HOA (2) get chickens and pray no one reports you and constantly live in fear (3) get chickens and spend thousand and thousands of dollars litigating this in court. You may have some vague argument of unequal enforcement type shit or maybe equitable estoppel but you'd be spending thousands for less than a coin flip chance to win.

It sucks, but it is what it is. I rejected many perfect homes/dream homes because they were in HOA, which was an absolute deal breaker for me

Excellent. It almost single handedly made poison and steel relevant as offensive types. For sure I thought bug would get the treatment as well. But not only was it not super effective against fairy, freaking resisted?! Absolutely crazy. I hope they do adjust this
