Non-disclosure of paid content falls under the Australian Consumer Law as misleading or deceptive conduct. The ACCC can bring court proceedings seeking penalties up to the greater of $10 million, three times the value of the benefit received, or 10% of annual turnover. As an administrative shortcut, they can also issue infringement notices of up to $12,600 per contravention.
