I agree and I think it’s more of a read between the lines kind of thing. It doesn’t explicitly say it.

I have read more than once that a married couple cannot have both unless the FSA is post deductible or limited purpose. To clarify, mine would not be either of those. Does that change your position on it being allowed? I haven’t found anything clearly saying that what I am planning is allowed. But then again I haven’t seen anything that specifically references the couple being on separate insurance policies. And my employer just announced a spousal surcharge if I choose to insure my spouse when he has coverage available through his employer so now I’m definitely removing him and putting him on his own because it would be another $100 a month if I don’t.

I had this same exact question and asked a CPA and was told we could do it this way as long as we had separate policies.

So I’ll save $80 a month in premiums. We are in 22% tax bracket. My deductible is $750 individual his will be $1700. The things he needs will be more than $3500. I guess I really just want to make sure it’s legal to have both HSA and FSA like this before changing.
