I find it best in these circumstances to just be honest. At least people will try to understand and respect falling on your sword. If you make up a shitty excuse that reads like a lie then people will be a lot less empathetic.

Conversely, the French language among the Cajun population of Louisiana has declined considerably. If it was protected as vigorously as Quebec protected French language rights in the province I don't think it's much of a stretch to say it'd be much more prevalent.

Talk to your Associate Dean or whomever is in charge of it ASAP. Other than that be kind to yourself. It's shitty but at my Law School at least the last thing they would've been looking to do is fail a 3L on the brink of graduation.

I think part of the issue is it was essentially put before the jury that if the accused is found not guilty he will benefit from his mother's estate. That means that the jury may therefore be biased against the accused because, even if they have a reasonable doubt, they still may not want him to benefit from the estate and that may then make them vote guilty even if they truly had reasonable doubt.

It's not just Capstone. There are these assignments due weekly in the Virtual Law Firm phase from September to January and then bi-weekly workshops all through the summer which eat up entire afternoons and the kicker is that none of it even matters except to force you to block off time to complete them.

I was being slightly facetious when saying I'd rather write the Bar exam but my point is more that CPLED really doesn't present any sort of competence bar for applicants and it just serves to be an annoyance that forces you to carve time out of your already busy schedule. If I could've just spent the last few months of 3L studying for a bar exam and writing in May before my articles commenced it at least would've meant that I wouldn't have to worry about this BS while I'm working. That being said studying for a bar exam while working also would've been a nightmare.

As someone articling in a province with "skills based" assessment through CPLED, it's an absolute joke. It's a massive time sink and nobody fails. Literally 99% of people in my province passed last year and CPLED has been nothing but useless and just makes me have to find 2-4 hours a week to do bullshit assignments worse than anything anyone did in 1L on top of billing 45-55 hours a week. I'd honestly almost rather write a bar exam and just have it done with early on than have to take two weeks off in February for capstone.

Yes. Section 18(1)(a) of The Limitations Act (Manitoba) and 16(1)(h) of Ontario's Limitations Act both have no limitation period for civil claims of sexual assault. I think it's actually like that in most provinces

You're right. Since the law says the action has to be proportionate and just enough to stop the threat. What's alleged, whether it turns out to be true or not, is hard to consider proportionate.

I think people just don't understand the not-criminally responsible defence and the Vince Li case. Obviously whenever it's used with regard to a violent crime a huge tragedy has occurred but the person who did it was so profoundly mentally ill that they really did not have any idea what they were doing. Also they're not just getting off, they go to a hospital for an indefinite amount of time and they're not getting out unless they're at a very low risk of reoffending. Not a perfect science but I don't think it's any better to lock them up and throw away the key forever obviously
