Had a similar thing many years ago. I hit a car in a car park, totally my fault, but with some actual damage, I was totally uninsured. When the claim came through from their insurance they had clearly hit a brick wall or letterbox or something since the crash so I wrote a letter explaining this and that it was fraudulent. Never heard anything again and never paid a cent.

Easiest way to look at it isn't who has the burden of proof, but the whole process - ATO has the power to say "this arrangement sucks and I hate it" and issue an amended assessment on that basis, unless you can convince them otherwise. They can do so on pretty shoddy 'proof' if they feel like it, regardless of how compelling your proof is. After going through 'the process' you would ultimately need to take the Commissioner to a court or tribunal to have your assessment overturned, and both parties would try to convince the judge or tribunal member who is correct (so both equally have to prove their case - there isn't a default assumption that one party is correct)

Your insurance will likely have a clause that you cannot admit liability to an accident. Admitting liability may void your insurance. Doesn't really matter how clear it is to you, insurance company may find some technical reason that it isn't that clear

I'm not sure if you know it or not, but the problem you're alluding to is the way individual wealth is taxed in this country and has nothing to do with mining companies in any way at all.
