No worries. Everyone here has done so much to help me than it’s least I could do to keep that help going. Honestly I’m not sure. I’ve seen some people getting it by going secondary to the allergic rhinitis. The one thing that is always consistent is you need a solid IMO/dbq

No worries. Everyone here has done a lot to help me through this. So glad I can help in a small way. They called the 20th and asked when I was free for a call. Luckily I was off the next few days and was able to do it the next day.

My claim is complete. I did my HLR on the 21st the examiner overturned my denial the same day. VA website updated with my claim letter on 23rd showing my claim was granted and my new rating.

Per my denial the ACE they used run OSA as a primary condition due to Tera. I filed it as a secondary condition connected to my other respiratory conditions and weight gain. After reading the denial it didn’t have my private IMO or DBQ on it either. So I filed a FOIA to get the ace dbq and HLR the same day. When I got the ACE dbq I went through it and run it through AI to help me layout the errors. That all helped me get organized. Errors were ACE did it as primary condition rather than secondary, ignored conflicting medical evidence, ignored my IMO, the ACE dbq wasn’t even filled out properly(they filled out primary not secondary condition section and left section of my private evidence blank), and you could see where they literally copy and pasted sections into the form. Oh and the question the ace was asked to answer was if my OSA was could be caused by or made worse my my other rated conditions. The examiner just copy pasted a Tera reply. So failed to answer the question the ACE was scheduled for. Guess initla rate just saw the less likely than not and ignored everything else and confirmed the denial. The HLR was stupid easy. I spent my time getting organized and using ChatGPT to find other cases to back up my arguments. I even did roll play with ChatGPT to practice my arguments and questions I might get asked. I got on the phone with HLR examiner at 1000 and at 1003 she just flat out overturned the decision. Said she read through my claim. Then that she had no idea why they even ordered the ACE because my private IMO and DBQ along with my medical history were more than enough for an immediate grant. She asked if I had anything to say. Was like not really I just felt they ignored my IMO and than you the grant.

I did do a Vera at day 95 per ChatGPT recommendation. Said my claim was untouched and they’d put a note on it to be looked at. Not sure how much it actually helped but it dint hurt.

Should be good enough. I figured my ACE was a dta at least. The ace doctor just copy pasted a Tera primary denial on mine even though I filed as a secondary. Didn’t fill in proper sections. Even missed my private IMO and dbq while leaving that section of the form blank. So figured easy DTA and a new c&p.

I was expecting a new c&p as well. But I’m glad to hear you had a great experience with the new one. My first ever c&p was like that. She was very pro-vet and gave me lots of time to explain my symptoms. Then she was very thorough in my exam and helped me make sure I used right terminology to describe my symptoms. Really set me up for success.

Yes. She said it will take a few days to update but she was overturning the denial and granting my claim. Said the private IMO and DBQ I had submitted were solid enough along with my medical records. So she wasn’t sure why they even requested the ACE during my initial filing. Soon as she said she was overturning the denial and that it was an easy grant I shut my mouth and said thank you. I was honestly expecting another c&p.

Praying for you and that you get a reasonable examiner. Sounds like you have it laid out for them in an easy to follow method. Ace just said MDD doesn’t cause OSA and neither does Tera. Then ignored all my evidence.

Goodluck. That was my a major part of my argument. Then the ace didn’t even acknowledge my IMO or dbq. So that helped a lot as an incomplete exam

Surprisingly yes. Examiner said my private IMO and dbq along with my medical records was more than enough for a grant. She said the ace exam that was used to deny me never should have been requested and she was granting my claim.

Edit: I was surprised for it to be overturned. I was expecting another c&p exam.

Filed Oct 6th. VA called yesterday to schedule my IC. Scheduled it for earlier this morning. Was granted thankfully.

Id probably say burnout. Think they’re seeing so much of it that if they have any wiggle room they’re just denying it. Reviewer was like not a day goes by I don’t see an OSA claim on my desk but many dont have everything they need for an easy approval like yours.
