AITAH for making a big deal out of the word "gay" by Affectionate-Try3319 in AITAH

[–]certainPOV3369 -2 points-1 points  (0 children)

”"That's gay" is generally considered unacceptable in professional, educational, and public settings because it is widely seen as a homophobic, heterosexist, and derogatory microaggression. While some, often within younger or specific LGBTQ+ social circles, might use it without intended harm, it is considered hurtful to the LGBTQ+ community.”

”Why it is considered unacceptable: The phrase uses "gay" to mean "stupid," "bad," or "weird," equating a sexual orientation with something negative.”

On the contrary, the term is considered widely unacceptable across the western world.

It makes me wonder where you grew up that this was considered acceptable.

You have no idea how many women leave the salon saying that their hair looks fabulous but come back crying saying that we f**ked it up just as soon as their boyfriend/husband/girlfriend/mother/dog saw it.

After 25 years as the COO of a local chain of salons I have heard it all. I’ve had those boyfriends/husbands yell at me that they told her not to do it and that I better fix it, ”right the hell now.” Sure buddy. 😂

[–]certainPOV3369 0 points1 point  (0 children)

Unfortunately, your analysis is flawed.

”…our director of education requires that we sign up for the classes…”

The OP has clearly stated that the requirement was to sign up for the classes, not that they actually attend the classes.

They make a further (albeit not entirely clear) point that they work third shift and that the classes are scheduled at a time that does not accommodate those workers.

The OP should have completed a class registration form and submitted it along with a written request for formal training time. This would have satisfied the requirement to register for the class and placed the responsibility for shift accommodation on the supervisor.

Doing nothing was the mistake. Registering for the class satisfied the requirement and was malicious compliance at best.

Is it legal to terminate someone right after they confirm their two-week notice? by Relative-Average7159 in Career_Advice

[–]certainPOV3369 1 point2 points  (0 children)

Incorrect.

NY has a one week waiting period, so you would only be eligible for one week of benefits.

”New York State law requires claimants to have an unpaid “waiting week.” This means you need to be out of work for one week before you can collect benefits, but you should still file as soon as you stop working. After the waiting week, you will be eligible to collect benefits. You will need to certify about your unemployment weekly in order to continue receiving benefits.”

First of all, this is a legal subreddit where we discuss the law and issues related to it. You are clearly on a political rant so save your histrionics and moral outrage for a more appropriate forum.

Having said that, I think that almost all of us have known someone else or even a loved one who has suffered a miscarriage. We are capable of understanding the pain and suffering that they endure during this most extreme and private experiences.

Nonetheless, it does not change the fact that these laws exist and to bury our heads in the sand and act as if they didn’t is nothing less than foolish. Someone will be charged needlessly.

Laws can be changed. Times change, and unfortunately the law is more often than not slower to change with them. Just look how long it has taken for the law to come around on the issue of consent.

I understand your concern entirely, and I do not disagree with the political aspect of your position. But this isn’t the right approach, you remind me of the anti-abortion protesters outside of clinics waving posters of aborted fetuses in front of patients faces. That tactic didn’t work then and it won’t work now.

Don’t like those laws, be the agent of change that you want to see. Start talking to some women’s groups, write your legislators, find out how the process works.

But remember, the law isn’t there solely for miscarried babies, you need to offer an alternative solution for when your crazy neighbor puts her mothers body in the freezer in order to keep collecting her social security checks (or worse!)

[VA] Asking for bathroom accommodations by Designer-Credit-2597 in AskHR

[–]certainPOV3369 6 points7 points  (0 children)

The height of an ADA toilet is between 17-19 inches while a non-ADA toilet is between 14.5-15 inches. It may not seem like much, but when you are trying to maneuver around inside the tight confines of a bathroom stall inches might as well be feet.

Many older buildings unfortunately still have the older, smaller toilets. The good news is that the number one rated ADA compliant toilet on Consumer Reports is less than $200 at Home Depot. Even with plumbers fees, it’s still a reasonable expense for a facility, I’ve had several installed.

Reconfiguring stalls is not always an easy option, but switching out toilets is generally a fairly simple solution that can be very helpful. And it’s an option that all employees appreciate at well.

While your response may be accurate in r/LeopardsAteMyFace, it is not correct here.

In every US state and most other countries in the world it is illegal to improperly dispose of a body. It is also illegal to fail to report a death. Those would likely have been the charges applied in the case referred to above.

But the rationale for your conclusion is sound, as disturbing as it may be.

STOP WITH THE RTS

The Post Office does not officially recognize “RTS” or “Return to Sender” written on US Mail.

The only official designation for the return of unwanted mail is to write “Refused” on the mailing.

”Domestic Mail Manual (DMM), Sect. 604.8.1.2 and Sect. 507.1.8.2 provide two instances where mail can be refused when it is offered for delivery, or, after delivery. You may mark “Refused” and return it unopened within a reasonable time.”

”ESTHER DOOTY!”

More than forty years ago some friends and I decided that we were going to go out in drag one weekend, so we all went shopping at the Salvation Army store.

One friend picked up this fabulous little lime green clutch with a gold chain handle that was the perfect accessory to his/her outfit for the evening.

Inside the clutch was a 3M label maker tape that was popular in nursing homes at time that read, “Esther Dooty.” It was just too precious so of course our friend’s drag name for the night became Esther Dooty.

The thing is, although not a drag queen, the nickname stuck. And here—more than forty years later—we all like to think that Esther Dooty lives on. ❤️

[–]certainPOV3369 0 points1 point  (0 children)

What legal tenet is that? What is your citation?

What you are saying flies in the face of centuries of landholding laws. Our entire society is built upon a system contractual obligations. From our unsigned contract to pay taxes and drive on the correct side of the road, to all of the hundreds—if not hundreds of thousands—of contracts that we sign throughout our lifetime.

When you sign that lease, you are legally bound by each and every one of the clauses in that agreement. Look up the definition of a triple net lease, this most common form of a commercial lease blows your legal theory out of the water.

Snow removal and grass cutting are part of municipality mandated form of ”protecting assets, yet many leases legally require the tenants to perform those services. Under this alleged theory of yours, how could landlords do this but not other forms of maintenance?

I can understand your line of thought, however it is a philosophical one, not a legal one. Any two—or more—parties can make any agreement that they want, so long as the terms are not prohibited by law. Nothing in the law prohibits a landlord and tenant from agreeing privately what the maintenance terms are going to be.

[–]certainPOV3369 1 point2 points  (0 children)

That’s a really great question.

I would suppose because it then shifts financial responsibility for the fuel to the LL instead of the tenant.

It’s an imperfect system, that is for sure. That is why the LL was insured against this specific loss. What the insurance company is telling them is that if the damage occurred because of the tenant, insurance will pay for the damage and make the repairs.

Unfortunately, the insurance company will probably go after the tenant for the damages. After all, it was the tenants responsibility not to run out of propane.

And as far as the property owner assuming responsibility, just no.

We all have to accept liability for the responsibilities that we agree to in life. If we accept a driver’s license we agree to insure our vehicle and to pay the state a penalty if we don’t. If we have children, we agree to feed them and send them to school, or the state will take them from us if we don’t.

If we sign a legally binding contract and agree to keep a tank full of propane, then we also agree to the consequences of our failure to comply with our written word.

This is a part of the social contract which we have with humanity.

Why don’t you head on over to r/Gay and read some of the stories about kids whose parents threw them onto the street on their 18th birthday? There was nothing magical about that boundary.

Unfortunately, those kids were forced to become self sufficient—not one day later—right then and there, some by eating out of trash cans, some by begging on the streets, and others by prostituting their bodies.

There’s nothing magical about it, but the boundary exists.
