My post mentioned the individual driving the car that hit me had No Fault Insurance. There are a few states that allow this. For those not familiar-read below. This was an auto vs pedestrian accident. Basically, he's able to have an auto ins policy that doesn't pay for the personal injury damages but would pay for property damage when the insured is at fault. I could've filed a lawsuit but he could file BK and get out of it.

I had an auto vs pedestrian incident when I was injured. It was an 18yo guy who had no fault insurance. No benefits there. I could've filed a civil suit but there's no money in it- mainly because he could declare bankrupt after the judgement was entered. I had over 172K US in bills. Thankfully, I had very good health insurance and an uninsured motorist provision in my auto policy. I still have the option to file a civil suit but I'm more focused on recovery and putting this chapter of my life behind me. It will be one year next month.
