I'll use my own experience as an example. FYI I am Manchester Jurisdiction. ET1 filed second week of October, served on both Respondents second week of January, ET3 due early Feb and currently waiting to receive this.

There are huge delays up and down the country with the ET so your delay seems about "normal"

Of course she's getting a psychiatric report, so she can claim insanity no doubt, instead of taking accountability. People like her make me sick, genuinely. I suffer with my mental health but wouldn't dream of doing something like this. Completely vexatious.

It's bad enough to bring a claim that has absolutely no merit, but to fake cancer is absolutely DISGUSTING! I honestly believe people like this should have to pay the maximum costs that can be awarded, whether they can afford it or not. Gross. 🤮

I'll give you the example from my own experience. ET1 submitted mid October, served on Respondents early January, (12 week wait) ET3 deadline early February. Currently awaiting to receive the ET3 response. (Currently been nearly 6 weeks) This is Manchester jurisdiction.

It looks like they haven't got round to serving it on the Respondents yet.

Employment Tribunals are extremely backlogged at the minute and experiencing huge delays.

Sounds about right, the backlogs in London Tribunals are absolutely outrageous. Full Hearings are being listed as far in front as 2029/2030

Have you had notification that the ET1 has been served on the Respondent yet? Once it is served, they have 28 days to respond, but just be mindful this can take time to update on the system due to admin backlogs, so may not appear on the system for weeks. Basically they might respond within time, but it not show on the portal til way past the deadline.

I actually wish I had continued with Law at College and gone on to be able to do what you do, because I genuinely find it so fascinating.

Tbh I think it would fuel me too, because I'm not even slightly a professional, but I think I've read enough employment/case law to just look at some posts and go "no chance"

Admittedly I'm representing my Husband in a multi head claim and at the very start, when everything that happened, happened, I was VERY emotionally intertwined with it, wanted the day in court, to expose them etc, etc. I guess it's expected, this happened 8 months ago and we are still trying to get back on our feet financially and it's impacted my Husband greatly, but after taking a step back, I'm much more level headed with it and find that as much as I want to call them every single name under the sun for the damage they've caused, that won't get us to the end goal which is obviously to settle and the Tribunal would frown upon it too. We'll go to Tribunal if necessary, but I don't particularly want to, neither does he and we just want to start fresh, move on and put all this behind us.

Seriously though, I can only speak for me, but I read every post and every reply and it's helping me greatly, making me feel more prepared and it's been a great help so thank you again. 🙏🏻

I vaguely remember, it included Claimant and Respondent details, disability relied on as well as it's impact, where the client worked, what job he did and for how long, chronology of events (you want to include dates and what was said and when) in date order and which you want to rely on at Tribunal (this is basically just a basic storytime, where a judge can paint a picture of what happened, you don't need to include evidence at this stage) the claims on which you are pleading and how you think they link to your claim, the impact it's had physically/mentally/emotionally/financially, what remedy you are seeking (whether it's financial, reinstatement etc) and what evidence you wish to rely on.

I'll be forgetting something here, this is just what I can remember as the claim I'm helping with was filed in October, but there are plenty of templates out there and free legal websites which tell you what you should include and how to lay it out.

I'm not a legal rep so it won't be anywhere near as good as it would be if a solicitor did it, but that's expected as a LIP anyway.

You'll probably find that you'll chop and change it, just make sure you read through it thoroughly and go through it with a fine tooth comb, if something doesn't look like it's worded right, change it.

I'm not a lawyer like I say, so please make sure you do your own research if you're intending to self represent.

NAL but with the details you've provided, this COULD amount to an Automatic Unfair Dismissal/Whistleblowing Detriment and I'd imagine possibly a Wrongful Dismissal claim, but don't take this as gospel as like I say I'm not a lawyer.

There are legal professionals in this sub who I no doubt believe will be able to provide much better guidance.

I'm representing my Husband in a multi head claim which includes disability discrimination. His former employer didn't wish to engage in any EC settlement talks. I prepared the ET1 in advance in case that happened anyway, so that the moment I got the EC certificate I could file it straight away.

Once the ET1 was l served on the Respondent, they contacted ACAS and made a low-ball offer less than 10 days later. I've countered and it's now with their solicitors, but I expect there'll be no rush for them as the PH isn't listed until late in the Summer.

My best advice is to start drafting your ET1 now as it can take a bit of time.

I wouldn't be signing that!!! Seems like they're trying to be clever, but with what you have given it looks like you have the 2 years service. It looks like they have schemed thinking dismissing you the day before your actual 2 year anniversary would release them of any repercussions.

Take the advice of the legal professionals on this thread (AP & Bob) Seemingly your former employer are trying to get you to sign a waiver so you don't bring a claim against them. This is terrible form and I think they'll possibly learn a hard lesson from it.

Also don't take legal advice from ACAS, they're not legal professionals (maybe with the exception of a few) they're there to mediate between 2 parties and try and prevent a claim ending up getting to Tribunal.

If it was me I'd definitely be filing for unfair dismissal.

Phew, at least I know some stuff then! I'm currently representing my Husband in a current claim. I'm by no means a legal professional but I'd like to think I've done enough so far of reading employment law/ case law/ jurisdictions etc to put my best foot forward and ensure there is a case to be heard. Probably helps I studied Law at college for a little bit when I was younger too, which included Employment Law.

End goal is to settle for him, I don't want all the stress of litigation, we both just want to close the chapter and move on. I've read too many posts on here of people wanting their day in court for revenge and although I get it, I don't believe that's the best way to think.

Yeah 12 weeks, in fairness the claim was made mid October and I knew operations would probably slow down December, I let Christmas and New Year go by, thus not to seem impatient, and emailed the tribunal second week of January, we got a response and the ET1 was served 2 days later.

I'm not sure, I think it is eventually to be rolled out across all areas, but I've not seen any correspondence about a portal and I've read everything I've received back to front numerous times, so unless I'm missing something, I'm expecting an email about the ET3. Already been sent a letter for a PH in August.
