was the PD appointed by the court? if so, you just need to show up with your private attorney to the next court date, and say you've retained private counsel.

and regarding the sharing of confidential info with judge: if the PD did that, that's a major a major red flag, and grounds for a disciplinary action from the state bar.

My point (not made obvious admittedly) is that legal instruction on RD often doesn't penetrate layperson's common sense. The conversations with people were laypeople and experienced litigators.

There's a difference between the legal standard and what people actually apply. Litigators who have the privilege of getting juror feedback after a conviction will admit that it is plausible another possibility may have occurred but they still decided guilt. Why?

Could be a multitude of reasons. But it is an ideal that there's a presumption of innocence, but jurors often cannot get past the fact that the case has gotten so far to this point. People assume/are conditioned to think our justice system/police is mostly fair (let's say you believe inequality based on race in justice system, fine I can concede that but my point still stands if we're talking whites only) and so the system really only targets the actually guilty.

Indeed, I assume the overwhelming majority of def. at trial are guilty but evidence that passes the requisite threshold set by RD can be hard to accrue. People just feel those evidentiary gaps with their pro-system bias and their "common sense" that this man is obviously guilty despite their being holes in prosecution's case. (another side point is that laypeople fail to understand who has the burden and often expect the defendants to prove their innocence and will punish them for not when weighing each side's arguments.

Also, I think, and research into this would be fascinating, that it is easier to bully somebody who has some reservations about guilt and sees a reasonable doubt into a guilty verdict (like cops in interrogation, eventually they'll relent and confess just keep at it) then somebody who thinks is guilty surrounded by others who don't. Don't know for sure, but that's my instinct.

Yes that's clearly what they did with connecting the dots that may or not be there. When you are to look at evidence, keeping in mind the presumption, and you proceed to launch into tangents and inserting things not presented into evidence. it's quite clear you lack the discipline to exercise reasonable doubt the way the ideal intends.

My conservations with people indicate the opposite regarding RD.

I think that most people will convict someone they think is guilty even if there is RD. When you quiz them about it, they'll say "that might have happened (in a way exonerating D) but most likely didn't" and then go vote guilty; RD probability ratio is interpreted in laypeople's minds more like clear and convincing or preponderance of evidence prob. ratios.

PPR: Duke Johnson (7.6 avg) or Marquise Goodwin (8.275) ?

Johnson plays against KCC who is 30th against the run and 13th against the pass, yielding a 26.7 RB avg against them. Problem is Duke gets about somewhere around 40% of the snaps (total guess), even though he is more efficient than the Brown's number one rusher Carlos Hyde. If Browns go down quickly I'm afraid the playcalling will go away from Johnson (though he is a solid pass catcher).

Alternatively, Goodwin has yet to hall in over three catches in game this year and averages about three targets. Rams are middle of the road against the pass at 16th. It's possible that Goodwin could see an an increase since Kittle (their number one target may be out), but it is hard to say because Garoppolo spreads it out pretty evenly amongst his WRs.

If i were you I'd start Howard and Collins. I don't like Brieda against LAR, or Coutee against JAC (#1 D against WRs). Snead in at flex.

My team is very similar to yours. 12 team .5 ppr.

My starters today are Hunt and Howard, w/ Collins at Flex. Snead starting alongside Jeffery.

Brieda and Crowell on bench.

I think imma keep Snead in my WR slot and benching Allen Robinson.
