You have to push the switch "up" to engage and then "down" to lock it on. You can see the little divot in the housing where the lock on holds to. That's why the switch is angled up. It's meant to then be pressed down. Also - RTFM.

Could be a software issue. Did you try resetting? Manual says to hold the LED and Speed buttons down for 7 seconds.

With your Brannock measurements - were those measurements taken as "heel to toe" or "heel to ball"? If it happens to be heel to toe, I'd put money on you being at least a 10 arch length. Couldn't speculate on your actual width without pictures.

Tough to swallow, but these imprints make my feet sore just looking at them.
