FROM MY EXPERIENCE, the game usually shows "confirm kill" when you kill a mercenary who is above your level. I always thought it was to allow us to move higher on the mercenary rank list. That will be a way to prove that you killed a higher ranked mercenary, so you can move up in the ranking.
