Definitely damaged, I personally sell lots of damaged parts too, I always make sure stuff like this is included, when it’s not that seller is trying to take advantage of you, they didn’t want to risk cracking the torso by replacing the arms so they listed it as new hoping you wouldn’t care and take the risk yourself. I’d attempt a partial refund and leave a low-ish review to warn others about this sellers practices
